1What does a wife's nushuz (marital defiance) mean in Islam?
A wife's nushuz means a wife departing from the obedience she owes her husband in what is right, without a valid Shariah reason.
Examples commonly given by Shafi'i scholars: leaving the house without permission and without need, refusing intimacy without an excuse, or refusing to live in the home the husband provides. Nushuz is not merely differing in opinion, sulking now and then or claiming lawful rights. Refusing an instruction that is sinful or harmful is also not nushuz. The Qur'an (an-Nisa' 4:34) sets out a staged approach to restore the situation, not to punish. Whether a wife is truly guilty of nushuz, especially where maintenance is concerned, is determined by the Syariah Court on the evidence. See also Nushuz & conflict and Rights of husband & wife.

2Is it true that Islam allows a husband to hit his wife? What does an-Nisa' 4:34 really mean?
No — Islam does not allow a husband to injure, hurt or abuse his wife; verse 4:34 is placed within very strict limits.
This verse mentions three steps for manifest nushuz: advice, separating beds, then darb. Classical scholars set conditions: it is a last resort, only if expected to be effective; it may not cause pain, leave a mark or touch the face; Ibn 'Abbas described it as with a tooth-stick (siwak) — symbolic in nature. The Prophet ﷺ said "a blow that does not injure" (ghayra mubarrih), and censured a husband who beats his wife and then sleeps with her. Imam al-Shafi'i held that refraining from it is better. Most importantly: the Prophet ﷺ never struck a single woman (Sahih Muslim, Kitab al-Fadha'il). Any injury is wrongdoing, forbidden, and a criminal offence in Malaysia. If you are hit, call the police 999, Talian Kasih 15999. See Nushuz & conflict.

Difference between schools. All four schools require that any striking must not injure; many Shafi'i and other scholars state that refraining from it is better, following the example of the Prophet ﷺ.

3My husband hits me. What should I do?
Your safety comes first — domestic violence is haram and a crime, and you are entitled to immediate protection.
If you are in danger, call the police on 999 or go to the nearest police station. For 24-hour support, call Talian Kasih 15999 (or WhatsApp 019-261 5999). Get treatment at the emergency department of a government hospital — One Stop Crisis Centre (OSCC) helps victims and records injuries. Under the Domestic Violence Act 1994, you can apply for a protection order. Islam has never required a wife to endure abuse patiently: the Prophet ﷺ forbade causing harm, and he himself never struck a wife. Leaving the home for your safety is not nushuz (marital defiance). Once you are safe, the Syariah Court can help with judicial dissolution (fasakh), maintenance (nafkah) and child custody. See Counselling and Nushuz & conflict.

4Can a husband also be guilty of nushuz?
Yes — the Qur'an itself mentions nushuz on the husband's part in an-Nisa' 4:128.
A husband's nushuz is when he is indifferent, turns away, neglects maintenance, does not give the wife her turn (in polygyny), is harsh or wrongs his wife. Verse 4:128 encourages husband and wife to seek a way of reconciliation (sulh), "and reconciliation is better". If the husband still neglects his responsibilities, the wife may complain to the Religious Affairs Office or the Syariah Court for a maintenance claim, an order that the husband act fairly, or in certain circumstances fasakh or khulʿ. The Prophet's ﷺ hadith stresses: "The best of you are those who are best to their families." See Nushuz & conflict and Rights of husband & wife.

5What is a hakam in marriage?
A hakam is a conciliating representative — one from the husband's family and one from the wife's family — appointed when a dispute between husband and wife becomes serious.
This is based on an-Nisa' 4:35: "If they both desire reconciliation, Allah will bring about agreement between them." The arbiters' task is to hear both parties, find the root of the conflict and propose a way to reconcile. Arbiters should be knowledgeable, fair and trustworthy. In Malaysia, the Syariah Court may appoint arbiters under the state Enactment when the dispute persists (shiqaq), and the court sets their authority. Arbiters are used only after the couple's own efforts have failed — not as a first step. See Counselling and Nushuz & conflict.

Difference between schools. The Shafi'i school (authoritative view) and the Hanafi school see the arbiters (hakam) as representatives who need the spouses' permission to separate them; the Maliki school sees them as judges who can decide on separation.

6What is sulh in the Syariah Court and is it compulsory?
Sulh is a process of reconciliation or negotiation conducted by a Sulh Officer at the Syariah Court to help the parties reach agreement without a trial.
It is commonly used for claims of maintenance, custody (hadhanah), mutʿah (consolatory gift), jointly acquired matrimonial property and other family matters. Both parties sit together, helped by a neutral officer, and the agreement reached can be recorded as a binding court order. Its basis is the Qur'an: "reconciliation is better" (4:128) and "make peace between your brothers" (49:10). Sulh is faster, cheaper and preserves relationships, especially for the children's sake. But it is not suitable if there is violence or fear — tell the officer if you are not safe. Detailed procedures depend on the state; see Nushuz & conflict and States.

7Where can I get marriage counselling in Malaysia?
You can get marriage counselling at the District Islamic Religious Affairs Office or the Family Consultation/Counselling Unit of the state Islamic Religious Department, which is usually free.
Other options include registered counsellors at government agencies, hospitals, universities and family NGOs. Counselling suits problems of communication, finances, family interference, polygyny conflicts and before deciding on divorce. Come with your spouse if possible; if your spouse refuses, individual counselling still helps. If there is violence, get protection first (999 / Talian Kasih 15999) — couples counselling is no substitute for safety. Lists and guidance are in Counselling and States.

8What are the correct steps under the Shariah if a wife is guilty of nushuz (marital defiance)?
The first step is gentle advice, then separating beds, and if still at an impasse, bringing in arbiters (hakam) or the authorities — not violence.
An-Nisa' 4:34 mentions advice, hajr (separation) in bed and darb; many scholars stress that these are in stages and that the last step is limited so as not to cause pain, and is better left undone, because the Prophet ﷺ never struck a wife (Sahih Muslim, Kitab al-Fadha'il). Before accusing her of nushuz, the husband should examine himself: have maintenance, good treatment and fairness been fulfilled? After that, verse 4:35 commands appointing arbiters. If this still fails, refer to the religious affairs office or the Syariah Court. See Nushuz & conflict and Counselling.

9Does a wife guilty of nushuz (marital defiance) lose her right to maintenance (nafkah)?
According to the Shafi'i school and Islamic family law in Malaysia, a wife found guilty of nushuz is not entitled to maintenance for herself throughout the period of nushuz.
But there are some important points: (1) nushuz must be proved — the husband's allegation alone is not enough, and the determination is made by the Syariah Court; (2) the right to maintenance returns when the wife resumes obedience; (3) child maintenance is not lost at all because of the mother's nushuz; (4) a wife who leaves the house out of fear of abuse or because the husband has not provided suitable housing is not counted as guilty of nushuz. A husband may not withhold maintenance at will on the pretext of "nushuz" without a court order. See Maintenance (nafkah).

10What is an Interim Protection Order (IPO) and how do I apply for one?
An IPO is a court order under the Domestic Violence Act 1994 that forbids the abuser from using violence against the victim while the case is investigated by the police.
Usual steps: make a police report, say that you want protection, and the police officer or Social Welfare Officer (JKM) will help with the application to the Magistrates' Court. The order can forbid the abuser from approaching the home, workplace or children. After charges are brought, the court can issue a Protection Order (PO). The Act applies to everyone, including Muslim couples, and does not conflict with Syariah because Islam forbids harm. Contact Talian Kasih 15999 for guidance. See Nushuz & conflict.

11What does 'separate from them in bed' mean and how long is it allowed?
Hajr in an-Nisa' 4:34 means the husband not sleeping with his wife, or turning away from her in bed, as a sign of displeasure, in the hope that she will reconcile.
It is done inside the home, not by leaving the wife outside or shaming her in front of others; the Prophet ﷺ advised "do not shun her except within the house" (narrated by Abu Dawud, hasan sahih). The texts set no fixed period; scholars say it should last only as long as needed to have an effect. The Prophet ﷺ once kept away from his wives for a month. Shafi'i scholars distinguish: separating beds is permitted for the purpose of correction, but not speaking for more than three days is forbidden. It is not a tool for punishment or torment. See Nushuz & conflict.

12Is it a sin for husband and wife not to speak to each other for days after a quarrel?
Not speaking for more than three days out of anger is forbidden between Muslims, let alone husband and wife.
The Prophet ﷺ said it is not lawful for a Muslim to shun his brother for more than three nights, and the better of the two is the one who greets first (Sahih al-Bukhari 6077; Sahih Muslim, Kitab al-Birr wa as-Silah wa al-Adab). The hajr in bed in an-Nisa' 4:34 is a limited corrective step, not permission for a prolonged "cold war". Days of silence usually worsen misunderstandings and affect the children. Try starting with a greeting, a short word or a gentle message, then talk once emotions have settled. If it keeps recurring, seek counselling.

13Is emotional abuse such as threats and insults counted as domestic violence?
Yes — in Malaysia, the Domestic Violence Act 1994 (as amended) recognises emotional, mental and psychological abuse as domestic violence, alongside physical and sexual abuse.
Examples include threats, constant insults, isolating the victim from family, excessive control of money, or threatening divorce and taking the children in order to frighten. From the Shariah perspective, all of this contradicts the command "live with them in kindness" (4:19) and the prohibition on harming one's wife (2:231). Victims can make a police report and apply for a protection order. Keep evidence (messages, recordings, witnesses) and contact the police 999, Talian Kasih 15999. See Nushuz & conflict.

14If a wife leaves the house out of fear of being beaten, is she guilty of nushuz?
No — a wife who leaves the house to save herself from danger or abuse is not counted as guilty of nushuz.
Scholars explain that a wife's obedience is only in what is right, and the prohibition on leaving the house falls away when there is an emergency or a threat to life, body or honour. The principle of la darar wa la dirar (no harm and no reciprocating harm) applies. The wife should go to a safe place — family, a shelter or a police station — and make a report so there is a record. Her right to maintenance remains, and the issue is ultimately decided by the Syariah Court if the husband alleges nushuz. Help: police 999, Talian Kasih 15999. See Nushuz & conflict.

15How should a polygynous husband resolve quarrels between his wives?
The husband must be fair, calm and impartial, and deal with the root of the conflict — usually a sense of unfairness in the rotation, maintenance or attention.
The Messenger of Allah ﷺ himself dealt gently with jealousy among his wives; when one wife broke a dish of food sent by her co-wife, he gathered up the food, said "your mother is jealous", and replaced the dish (Sahih al-Bukhari 5225). Practical steps: keep the rotation precisely, do not speak ill of one wife to another, do not compare them, and listen to each wife separately. Separate homes reduce friction. If disputes continue, seek counselling. See Relations between co-wives and Counselling.

16My husband is unfair in the rotation of nights and maintenance. What can a wife do?
The wife has the right to raise it, ask for fairness and, if nothing changes, take a complaint to the religious affairs office or the Syariah Court.
Fairness in the rotation of nights and in maintenance is obligatory for a polygynous husband (4:3), even though equal inclination of the heart is not required (4:129). Start by discussing it calmly and specifically — note down dates and facts. If that fails, ask a trusted family member or a counsellor to intervene. The court can order maintenance, and under state enactments, unfair treatment of a wife can be an offence and, in certain circumstances, grounds for a fasakh claim. See Managing the rotation, Maintenance (nafkah) and Talaq & divorce.

17My husband does not pray and refuses to change. What should a wife do?
Keep advising your husband with wisdom and patience; abandoning prayer is a major sin, but according to the Shafi'i school it does not by itself annul the marriage.
Allah commands the head of the family to enjoin prayer on his household and to be patient in it (Taha 20:132), and the Prophet ﷺ described prayer as the dividing line between a person and disbelief (Sahih Muslim, Kitab al-Iman). Begin with example and gentle invitation — praying together at home, reminders at calm moments, not during a quarrel. Do not insult him or expose his faults to others.
If there is no change, ask for help from someone he respects, such as his parents, an imam or a marriage counsellor at the religious affairs office. If his refusal comes with other harm, such as neglect of maintenance or violence, get advice from a Syarie lawyer about the options at the Syariah Court. See Nushuz & Conflict and Counselling.

Differences between the schools. Shafi'i, Maliki and Hanafi: abandoning prayer out of laziness without denying its obligation is sinful (fasiq), not apostasy, so the marriage remains. The well-known Hanbali view regards it as disbelief (kufr), which affects the marriage — consult a mufti or the court in an actual case.

18How does one control anger when quarrelling with one's husband or wife?
Pause the conversation, seek forgiveness and change your state — that is the sunnah guidance when angry.
When a man asked for advice, the Prophet ﷺ said repeatedly: "Do not get angry" (Sahih al-Bukhari 6116). He also said the strong person is the one who can control himself when angry (Sahih al-Bukhari 6114). Among the recommendations: say a'udzu billahi minasy-syaitanir-rajim, sit down if standing (narrated by Abu Dawud, sahih), stay silent, make wudu, and step away for a while. Allah praises "those who restrain their anger and pardon people" (3:134). Agree on a "time-out signal" with your spouse and resume the discussion when calm. If anger leads to threats or violence, seek counselling.

19How should husband and wife communicate well according to the sunnah?
Speak well or keep silent, listen carefully and be gentle — that is the basis of communication between husband and wife in Islam.
The Prophet ﷺ said: "Whoever believes in Allah and the Last Day, let him speak good or keep silent" (Sahih Muslim, Kitab al-Iman). He was attentive to his wife's emotions; he once told Aishah r.a. that he knew when she was pleased and when she was angry (Sahih al-Bukhari 5228; narrated by Muslim). Practical habits: use a gentle tone, speak of your own feelings ("I feel…") rather than accusations, avoid raking up old mistakes, give praise and thanks, and set aside time to talk every day. Allah commands: "Say that which is best" (17:53). See Approaches to persuasion.

20My in-laws interfere too much in our marriage. How do we resolve it?
Keep respect for the in-laws, but husband and wife need to set boundaries together, wisely.
Being good to parents is obligatory, but household decisions are the responsibility of husband and wife. Practical steps: discuss it between the two of you first and stand united; let each one's own child (the husband with his mother, the wife with hers) convey the boundaries gently; avoid complaining about your spouse to the in-laws. The wife is entitled to housing that gives her privacy — Shafi'i scholars state that a wife is not obliged to live under the same roof as her husband's family if they harm her. If you reach an impasse, ask a respected intermediary or a counsellor. See Rights of husband & wife and Counselling.

21My husband has not provided maintenance (nafkah) for months. What action can be taken?
The wife can file a maintenance claim at the Syariah Court, and the court can order the husband to pay current maintenance and arrears.
Material maintenance (nafkah zahir: food, clothing, accommodation) is obligatory on the husband according to his means (2:233, 65:7). Before going to court, try discussing it or seek counselling and mediation (sulh). If the husband defies a court order, enforcement action can be taken, including salary deduction; some states have a Family Support Division (Bahagian Sokongan Keluarga) that helps. Not providing maintenance for a certain period can also be grounds for fasakh under state enactments. Hind was allowed to take what was sufficient from her miserly husband's wealth (Sahih al-Bukhari 5364). See Maintenance (nafkah) and Calculator.

22Must a wife obey her husband in everything?
No — a wife's obedience to her husband is obligatory only in what is right (ma'ruf: good and reasonable), not in sin or in what causes harm.
The Prophet ﷺ said: "Obedience is only in what is right" and there is no obedience to any created being in disobedience to Allah (Sahih al-Bukhari 7257; Sahih Muslim, Kitab al-Imarah). For example, a wife is not obliged to follow an instruction to abandon prayer, uncover her ʿawrah, hand over her own property against her will, or cut ties with her parents. At the same time, the husband as qawwam (4:34) carries the responsibility to lead, protect and provide maintenance — that leadership is a trust, not absolute power. Both have rights and duties (2:228). See Rights of husband & wife and Nushuz & conflict.

23I found out my husband is cheating with another woman. What should I do?
Calm yourself, verify the facts, and get support before making big decisions.
An extramarital relationship is a major sin, and you have every right to feel hurt. Avoid acting when emotions are at their peak, such as attacking the third party or exposing it on social media. Talk to your husband directly; if needed, bring in an intermediary or counsellor. If your husband intends to marry, remember that polygyny in Malaysia requires court permission and the existing wife has the right to be heard. You also have the right to ask for sexual health screening. If the relationship cannot be repaired, options such as khulʿ (tebus talak) or fasakh can be discussed with a Syarie lawyer. See Counselling, Nushuz & conflict and Talaq & divorce.

24May I accuse my spouse of adultery if I only suspect it without proof?
No — accusing someone of adultery without lawful proof is a major sin (qazaf) and can be punished.
The Qur'an requires four witnesses for an accusation of zina (24:4), and commands avoiding suspicion and not spying (49:12). For a husband who is sure his wife has committed zina but has no witnesses, the Shariah provides the liʿan procedure before a judge (24:6) — it is a serious process with permanent effects and only through the court. If you suspect something, discuss your concern with your spouse honestly without accusing, and get help from a counsellor. Excessive, baseless jealousy can also destroy a marriage. See Talaq & divorce.

25May a husband or wife check their spouse's phone without permission?
In general, spying on a spouse's phone without permission is prohibited because the Qur'an forbids tajassus (searching out people's faults).
Verse 49:12 commands avoiding much suspicion and not spying. Marriage is built on trust; secret checking usually breeds more suspicion and quarrels. It is better for spouses to agree on transparency — for example sharing passwords voluntarily. If there are strong signs of danger (for example a threat to the children or to safety), refer to the authorities rather than acting alone. Evidence obtained wrongfully may also be problematic in court. Discuss your concerns directly and get counselling if trust has already cracked.

26Should we stop and take a break when a quarrel gets heated?
Yes — pausing when emotions peak is in line with the sunnah and very effective in avoiding words you will regret.
Many pronouncements of talaq, threats and insults come out in anger. The Prophet ﷺ taught changing one's position when angry and keeping silent. Agree on a phrase, for example "let's continue after Asr", so that the break does not mean running away. Use that time to make wudu', pray, walk or write down what you really feel. Come back to the discussion within 24 hours; do not let it drag on for more than three days. Spouses should also avoid pronouncing divorce in anger — the consequences are serious and must be referred to the court. See Ways of making up.

27Why does Islam place such emphasis on reconciliation before divorce?
Because marriage is a mithaqan ghaliza (a solemn covenant) and divorce has a great impact on the couple, the children and the family.
The Qur'an mentions steps towards peace repeatedly: advice (4:34), arbiters (hakam) (4:35), and "reconciliation is better" (4:128). The Prophet ﷺ told that Iblis is most pleased with the devil who succeeds in separating husband and wife (Sahih Muslim, Kitab Sifat al-Qiyamah wa al-Jannah wa an-Nar). He also urged that a believer should not hate his wife: if he dislikes one trait, he will like another (Sahih Muslim, Kitab ar-Radha'). Nevertheless, divorce remains permitted when the marriage can no longer be saved or there is injustice. See Nushuz & conflict.

28My spouse makes the same mistake over and over. Should I keep forgiving?
Forgiving is noble, but forgiving does not mean letting wrongdoing continue without change.
Allah praises those who forgive (3:134; 24:22), and the Prophet ﷺ advised looking at a spouse's other good qualities (Sahih Muslim, Kitab ar-Radha'). Distinguish between ordinary weaknesses (forgetfulness, lateness, lack of romance) that call for patience, and serious repeated wrongs (violence, infidelity, failure to provide maintenance, addiction) that call for action. For serious ones, forgive in your heart but set clear conditions for change, involve a counsellor, and protect yourself and your children. Where violence is involved, safety comes first — contact the police 999, Talian Kasih 15999. See Counselling.

29What is an Emergency Protection Order (EPO)?
An EPO is an immediate protection order under the Domestic Violence Act 1994 issued by a Social Welfare Officer (JKM) without needing to wait for court proceedings.
It was introduced through an amendment to the Act to protect victims quickly, especially outside office hours or when the victim has not yet made a police report. An EPO is in force for a short period (7 days) and can forbid the abuser from using violence or approaching the victim. After that, the victim can proceed with an IPO or other orders. Contact Talian Kasih 15999 or the district JKM office, and 999 if in immediate danger. See Nushuz & conflict.

30What happens after I make a police report about domestic violence?
Your report will be investigated by the police, and you may be referred to the JKM and helped to apply for a protection order.
Usually: a police officer takes your statement, you are referred for a medical examination (the OSCC at a hospital), and a case is opened under the Penal Code together with the Domestic Violence Act 1994. You can ask for an IPO during the investigation and, if needed, be placed in a shelter. The report also becomes important evidence in Syariah Court claims such as fasakh, maintenance and custody (hadhanah). Making a report is not disobedience to your husband — Islam forbids injustice. Keep a copy of the police report. Help: police 999, Talian Kasih 15999. See Nushuz & conflict.

31What is the OSCC and how does it help victims of domestic violence?
The OSCC (One Stop Crisis Centre) is a service in government hospital emergency departments that helps victims of domestic violence, rape and abuse in an integrated way.
At the OSCC, victims receive medical treatment, injuries are recorded in a medical report (important evidence), and the hospital team can connect victims with the police, Social Welfare Officers and counsellors. You can go straight to the emergency unit and tell the staff that you are a victim of violence. Go as soon as possible after the incident so that the injuries can be recorded. For support at any time, call Talian Kasih 15999; if you are in danger, 999. See Nushuz & conflict.

32I am a husband and my wife often hits and insults me. Is there help for men?
Yes — domestic violence can happen to anyone, and men are also entitled to protection and help.
The Domestic Violence Act 1994 protects all victims regardless of gender, including through protection orders. Islam forbids injustice by any party, and a husband need not be ashamed to seek help. Steps: ensure your safety, keep evidence (photos, medical reports, messages), make a police report, and contact Talian Kasih 15999. Avoid retaliating with force, as it can harm you legally. Counselling at the religious affairs office or the Syariah Court can help resolve the marriage or end it fairly. See Counselling.

33What is the ruling on a husband who constantly swears at and insults his wife?
Swearing at and insulting one's wife is forbidden and contrary to the command to live together honourably.
Allah says: "And live with them in kindness" (4:19). In the hadith on the rights of the wife, the Prophet ﷺ forbade a husband to strike the face or to revile his wife (narrated by Abu Dawud, hasan sahih), and stressed that the best of people are those who are best to their wives (Jami' at-Tirmidhi 1162). Constant insults can also count as emotional abuse under Malaysian law. A wife may remind him calmly, ask for counselling, and if it continues, complain to the Religious Affairs Office or the Syariah Court; mistreatment can also be a basis for fasakh. See Nushuz & conflict.

34My husband threw me out of the house during a quarrel. What are my rights?
A husband must provide his wife with housing, and throwing her out without right is an injustice.
Housing is part of obligatory maintenance (65:6), and Allah forbids keeping or treating a wife with the intention of harming her (2:231). A wife who is thrown out is not counted as in nushuz and her right to maintenance remains. If it is safe, try to calm the situation and ask for an intermediary. If you have been thrown out and have nowhere to go, go to your family's home or a shelter, make a police report for the record, and contact Talian Kasih 15999. The Syariah Court can order maintenance, including housing. See Maintenance and Nushuz & conflict.

35A wife sulks and goes back to her parents' home without permission. Is she guilty of nushuz (marital defiance)?
Not necessarily — it depends on the reason and the duration; leaving out of fear, because of mistreatment or because no maintenance was given is not nushūz.
From the standpoint of fiqh, a wife who leaves the home without permission and without a valid Shariah reason may be counted as nushūz. But before applying the label, the husband should ask: why did she go? Sulking is often a sign of a wound that has not been heard. The Sunnah approach is to coax her gently, invite her home, and resolve the cause. Ali and Fatimah r.a. once had a disagreement, and the Prophet ﷺ coaxed Ali with an affectionate jest, "get up, O Abu Turab" (Sahih al-Bukhari 6204). If it drags on, involve both families as arbiters (ḥakam). The determination of nushūz for the purposes of maintenance is made by the Syariah Court. See Ways to win hearts.

36What is the Conciliatory Committee (Jawatankuasa Pendamai) in a divorce application?
The Conciliatory Committee is a committee appointed by the court to try to reconcile husband and wife when one party does not agree to the divorce application.
In the Federal Territories, it is provided for in s.47 of Act 303; other states have similar provisions in their own Enactments. The committee is usually made up of a religious officer as chair and representatives of the husband and wife, preferably close relatives. They are given a set period to seek reconciliation; if they fail, the committee informs the court and the application proceeds. This process puts into practice the spirit of an-Nisa' 4:35. See Nushuz & conflict and Talaq & divorce.

37When should a marital conflict end in separation?
When all efforts at reconciliation have failed, or there is serious wrongdoing such as violence, separating on good terms is permitted and sometimes better.
The Qur'an says: "retain them honourably or release them kindly" (2:229), and forbids keeping a wife in order to harm her (2:231). The Prophet ﷺ allowed the wife of Thabit bin Qais to redeem herself by khulʿ because she could not live with him (Sahih al-Bukhari 5273). The route depends on the party: the husband may apply for talaq; the wife may apply for khulʿ (redemption divorce), fasakh on specific grounds, or divorce by taʿliq. All go through the Syariah Court. A wife who asks for divorce without reason is censured in the hadith, but when there is harm, seeking a divorce becomes her right. See Talaq & divorce.

38My wife often contradicts and argues with me. Is that nushuz (marital defiance)?
No — differing in opinion and arguing respectfully is not nushuz; the wives of the Prophet ﷺ themselves answered him back.
Umar r.a. was once taken aback when his wife answered him back, and she replied that the wives of the Prophet ﷺ did the same (Sahih al-Bukhari 5191; narrated by Muslim). The Prophet ﷺ met differences of opinion with patience. Nushuz is refusing to fulfil one's duties without a Shariah reason, not voicing an opinion. A good husband listens, because a wife often sees what her husband does not — Umm Salamah r.a. gave sound advice to the Prophet ﷺ at Hudaibiyah. But adab is still needed on both sides: no insults and no shouting. See Rights of husband & wife.

39My spouse is addicted to drugs or gambling. What can I do?
Put the safety of yourself, your children and the family's finances first, while encouraging your spouse to get treatment.
Alcohol, gambling and drugs are forbidden and destructive (5:90), and addiction is an illness that needs treatment, not just advice. Steps: protect the family's money (separate accounts), do not take on their gambling debts, get help from the National Anti-Drug Agency (AADK) or an addiction specialist, and join family counselling. If addiction leads to violence or neglect of maintenance, make a police report and contact Talian Kasih 15999. The Syariah Court can deal with maintenance claims and, in certain circumstances, judicial dissolution (fasakh). See Counselling and Nushuz & conflict.

40How do I keep evidence of abuse and plan for safety?
Record every incident safely and prepare a safety plan before the situation becomes an emergency.
Useful evidence: dated photos of injuries, medical reports (OSCC), copies of police reports, screenshots of messages or threats, notes of the dates and times of incidents, and the names of witnesses. Keep copies where the abuser cannot reach them — a personal email or with someone you trust. Safety plan: prepare a bag with your IC, marriage certificate, children's birth certificates, medicine, money and phone; memorise important numbers; identify a safe place; and agree a "code word" with a neighbour or family member. Contact the police 999, Talian Kasih 15999 or JKM for a shelter. This evidence also matters in the Syariah Court. See Nushuz & conflict.

41My husband keeps threatening to divorce me every time we quarrel. What should I do?
Repeated threats of divorce are a form of emotional pressure that does not fit Islamic character, and must be dealt with seriously.
Talaq is not a tool for frightening; Allah warns against making His verses a jest (2:231). Persistent threats can count as emotional abuse under Malaysian law. At a calm moment, tell him the effect the threats have on you, and ask him to promise not to use them again. If words of talaq have actually been uttered, do not decide for yourself whether it has taken effect — refer to the Syariah Court or the religious affairs office for confirmation, as it depends on the words used and the intention. Get counselling, and see Talaq & divorce.

42My child saw their father hitting me. What is the effect and what should be done?
A child who witnesses domestic violence is also a victim, and protection and emotional support for them are as important as your own safety.
Research shows that such children are at risk of anxiety, sleep problems, depression and repeating the pattern of violence. Steps: ensure safety (call the police 999, Talian Kasih 15999), explain to the child in simple language that it is not their fault, keep up routines, and get child counselling through a hospital, the JKM or the school. Protection orders under the Domestic Violence Act 1994 can cover the children. In the Syariah Court, the child's safety is a primary consideration in custody (hadhanah). See Children and Nushuz & conflict.

43My spouse is so jealous that they control my every movement. Is that normal?
Moderate jealousy is natural, but jealousy that controls, spies on and isolates a spouse is unhealthy and can be emotional abuse.
Scholars distinguish praiseworthy jealousy (guarding honour against what is truly forbidden) from blameworthy jealousy (based on groundless suspicion). The Qur'an forbids suspicion and spying (49:12). Warning signs: checking the phone constantly, preventing meetings with family and friends, controlling all the money, threats or violence. Discuss it calmly and suggest counselling; extreme jealousy often stems from anxiety or old trauma. If there are threats or violence, call the police 999, Talian Kasih 15999. See Counselling.

Shiqaq is a prolonged and serious dispute between husband and wife that makes living together difficult, and it is the term used in an-Nisa' 4:35.
The verse begins: "And if you fear a breach (shiqaq) between the two, then appoint an arbiter (hakam) from his family and an arbiter from her family." In Malaysia, when the court finds that shiqaq is continuing, it can appoint arbiters (hakam) under the state enactment. Shiqaq differs from nushuz: nushuz usually refers to one particular party who is defiant, whereas shiqaq is a two-way conflict where it is unclear who is the cause. The resolution begins with sulh and hakam. See Nushuz & conflict and Talaq & divorce.

45Should I agree to sulh (reconciliation) if my husband has abused me?
You do not have to face or reconcile with an abuser; your safety comes first and you can ask for a safe procedure.
The principle of sulh (mediation) in Islam is a just reconciliation (4:128), not forcing a victim to accept injustice. The principle la darar wa la dirar puts preventing harm first. Tell the Sulh Officer or the court about the history of violence, and show the police report or protection order; you can ask for separate sessions, for a lawyer to be present, or to go straight to a hearing. An agreement made under fear does not reflect true consent. For immediate help: police 999, Talian Kasih 15999. See Nushuz & conflict and Women's Rights.

46I am being abused but am afraid to divorce because of the children and finances. What are my options?
You have options and support — safety can be achieved without immediately deciding to divorce, and the law protects your rights to maintenance and to custody (hadhanah) of your children.
First step: protection. Contact the police 999 or Talian Kasih 15999; JKM can issue an emergency protection order and provide a shelter. Next, the Syariah Court can order maintenance for the wife and children, and young children are usually placed in the mother's care if she is eligible. Legal Aid (Biro Bantuan Guaman) and NGOs can help with lawyers' costs. Islam does not require a wife to endure abuse patiently (Sahih Muslim, Kitab al-Fadha'il shows that the Prophet ﷺ never struck a wife). Take your time, but do not face this alone. See Nushuz & conflict, Maintenance and Custody & lineage.

47We keep quarrelling about how to raise the children. How can we find a middle way?
Agree on a few core principles in private, then present a united front to the children; different styles can complement each other if they are not turned into a contest.
The Quran describes decisions about a child being made with the parents' mutual consent and consultation (al-Baqarah 2:233), and every parent is a guardian who will be questioned (Sahih al-Bukhari 893). Practical steps: list what really matters (prayer, safety, manners, screens) and agree the rules; leave small things to each one's style; do not overrule your spouse in front of the children; and discuss difficult cases after the children are asleep. Children quickly learn to "go to the softer parent" if parents disagree. If the differences are very large, take a parenting course together or see a family counsellor. See Educating the family.

48After a quarrel my spouse posted sarcastic or humiliating comments about me on social media. What should I do?
Do not reply on social media; ask privately for the content to be removed, keep evidence, and resolve the real issue through discussion, a mediator or a counsellor.
Allah does not love evil being publicised except by one who has been wronged, to claim their right (an-Nisa' 4:148), and warns those who love to spread indecency among the believers (an-Nur 24:19). Public jibes at one's spouse also break the prohibition on insulting and calling by offensive names (al-Hujurat 49:11). Replying only prolongs the quarrel and drags in the children, relatives and employers. If the content is defamatory, threatening or exposes private matters, take screenshots and seek advice; reports can be made to the platform or the authorities. Also agree a shared rule: marital problems are not taken to social media. See Digital life & the family.

49My husband threatens to marry another woman every time we quarrel. How should I deal with this?
Threats like these do not solve problems; they hurt and create insecurity. Calmly explain their effect and ask for the real issue to be discussed.
Allah commands husbands to live with their wives in kindness (an-Nisa' 4:19), and polygamy is a great trust conditional on justice (an-Nisa' 4:3), not a weapon in a quarrel. In Malaysia a husband who wishes to marry again must obtain the Syariah Court's permission, and the existing wife may be heard. A helpful response: "When you say that, I feel unvalued. What is it you are really unhappy about?" If there are unresolved issues such as intimacy or communication, discuss them with a counsellor. If the threats come with constant humiliation, they may amount to emotional abuse. See The existing wife.

50My spouse says they want to die or kill themselves during quarrels or when under stress. What should I do?
Take it seriously every time, even if said in anger; make sure they are not alone, remove dangerous items, and get help immediately.
Allah forbids killing oneself and says He is Most Merciful to us (an-Nisa' 4:29), and preserving life is among the main aims of the Shariah (al-Ma'idah 5:32). Words like these are often a sign of deep emotional pain, not mere threats. Steps: listen without judging; ask directly whether they have a plan; do not promise to keep it secret; call Befrienders KL 03-7627 2929 or the HEAL line 15555, or take them to a hospital emergency department; if the danger is immediate, call 999. After the crisis, get ongoing psychiatric treatment or counselling. If such threats are used repeatedly to control you, get support for yourself as well. See Mental health.

51My spouse seems depressed, withdrawn and uninterested in everything. How can I help without quarrelling?
See it as a possible illness, not laziness or weak faith; talk gently and encourage seeing a doctor or counsellor.
Allah does not burden a soul beyond its capacity (al-Baqarah 2:286), and the Prophet ﷺ himself went through a year of sorrow and was supported by Khadija r.a. Signs of depression include lasting sadness, loss of interest, changes in sleep and appetite, fatigue, feeling worthless or thoughts of death. How to help: listen without lecturing; avoid lines like "just strengthen your faith"; offer to go with them to a health clinic or doctor; lighten their household load for a while; and look after yourself too. Depression can be treated with counselling and medication. If there is any mention of suicide, get help at once. See Mental health.

52My spouse's siblings keep stirring up trouble or interfering in our marriage. How can this be handled?
Let your spouse set the boundaries with their own siblings, and agree as a couple first; do not argue directly with the in-laws.
Allah commands verifying news before acting on it (al-Hujurat 49:6), and forbids tale-bearing and suspicion (49:12). The Prophet ﷺ said that a tale-bearer will not enter Paradise (Sahih al-Bukhari 6056). Practical steps: do not share marital problems with in-laws; when you hear a story, check it with your spouse; ask your spouse to tell their siblings that household matters are decided by the two of you; and keep polite family ties. If interference continues and does damage, reduce contact for a while and see a counsellor. See In-laws.

53I want to go to marriage counselling but my spouse refuses. What are my options?
Go on your own first; individual counselling still helps you understand the pattern of conflict and how to respond, and often makes the other spouse more open later.
Allah encourages reconciliation, saying that settlement is better (an-Nisa' 4:128), and appointing arbiters when a breakdown is feared (an-Nisa' 4:35). A spouse usually refuses out of embarrassment, fear of being blamed or thinking counselling is "for people about to divorce". How to invite them: use "we" and "for the family", not "you are the problem"; suggest a counsellor they would be more comfortable with, for example a male counsellor or a qualified religious teacher; and suggest one trial session. District Islamic religious offices offer marriage guidance, and in court proceedings, sulh and the Conciliatory Committee also help. See Counselling.

54We keep fighting about the same issue. How can we break the cycle?
Work out whether the issue can be solved or needs to be managed; many differences in marriage never disappear, but can be arranged so they no longer spark quarrels.
Allah praises those who restrain anger and forgive (Al ʿImran 3:134), and the Prophet ﷺ guaranteed a house in Paradise for one who gives up arguing even when right (Sunan Abu Dawud 4800). Practical steps: choose a calm moment, not right after the issue arises; each explains what they really feel and need behind the issue; find a specific compromise and try it for a month; agree a signal to stop when voices rise; and write the agreement down. If every quarrel ends with dredging up the past, a counsellor can help break the pattern. See Emotional communication.

55My husband hits the children excessively when he is angry. What should I do?
Protect the children first; hitting that causes injury, hitting the face or hitting in anger is not permitted and may be child abuse.
The Prophet ﷺ forbade striking the face (Sahih Muslim, Kitab al-Birr wa as-Silah wa al-Adab) and never struck anyone with his hand except in battle (Sahih Muslim, Kitab al-Fadha'il). Allah commands protecting one's family from ruin (at-Tahrim 66:6). Steps: calmly stop the situation and take the child somewhere safe; once your husband is calm, discuss the effect on the child and other ways of discipline; suggest an anger-management course or counselling. If there is injury, take the child to hospital; the Child Act 2001 (Act 611) protects children, and reports can be made to the police or Talian Kasih 15999. See disciplining without hitting.

56Since our baby was born we often quarrel. Is this normal, and how can we get through it?
It is normal and very common; lack of sleep, changing roles and hormones make couples more easily irritated. What matters is working as a team, not competing over who is more tired.
The Quran describes pregnancy and nursing as weakness upon weakness (Luqman 31:14), and tells us to decide matters concerning a child by mutual consent and consultation (al-Baqarah 2:233). The Prophet ﷺ helped with household work (Sahih al-Bukhari 676). Practical steps: take turns with night duties; accept help from family; lower housework standards for a while; find ten minutes a day to talk together; and avoid big decisions when exhausted. Husbands sometimes feel sidelined when the wife's attention is on the baby; say so gently, not angrily. If the mother seems very sad or anxious for more than two weeks, see a doctor. See Mental health.

57Our sexual desires are very different and it has become a cause of quarrels. How can we resolve it?
Talk openly without blame, look for a meeting point, and check for physical or emotional causes; intimacy is the right of both spouses, not just one.
Allah describes husband and wife as garments for each other (al-Baqarah 2:187) and commands living together in kindness (an-Nisa' 4:19). The Prophet ﷺ affirmed that your wife has a right over you (Sahih al-Bukhari 1975), and also urged wives not to refuse without excuse. Differences in desire often stem from fatigue, stress, medication, hormonal problems, pain, unresolved conflict or feeling unappreciated. Steps: talk outside the bedroom; explain what makes each of you feel close; schedule time together; and see a doctor if there are health problems. Coercion is not permitted, and persistent refusal without reason also damages a marriage. See Etiquette between spouses.

58We are from different ethnic groups or states, and family customs often clash. How can we manage this?
Separate religion from custom: religious matters are held in common, while customs are negotiated with respect for both families.
Allah made people into nations and tribes so they might know one another, and the most honoured is the most God-conscious (al-Hujurat 49:13). Customs that do not conflict with the Shariah are acceptable, but no custom is nobler than another. Common conflicts: wedding arrangements, the language at home, food, child-rearing, the role of a son- or daughter-in-law and how often to visit the home town. Steps: discuss expectations early; teach the children both cultures; do not belittle your spouse's customs in front of family; and face family criticism as a team. Cultural differences can enrich a family if handled with humour and patience. See In-laws.

59My spouse lies again and again, even about small things. How can trust be rebuilt?
Trust is rebuilt through consistent honesty over a long period, not promises; set clear boundaries and the consequences if it happens again.
The Prophet ﷺ said that truthfulness leads to goodness and lying leads to wickedness (Sahih al-Bukhari 6094), and lying is one of the signs of a hypocrite (Sahih al-Bukhari 33). Look for the cause: some people lie out of fear of an angry reaction, shame, or to hide a bigger problem such as debt, gambling or another relationship. Steps: tone down reactions that make your spouse afraid to be honest; ask for openness on important things such as money and whereabouts; check facts without spying; and appreciate honesty when it happens. If the lies cover serious matters, see a counsellor. See Emotional communication.

60A spouse or former spouse is threatening to share intimate photos or videos. What should be done?
Do not give in to the threat; keep evidence, make a police report at once, and report to the platform so the content is blocked. You are the victim, not the offender.
Allah gives a stern warning to those who love indecency to spread among believers (an-Nur 24:19) and to those who hurt believers undeservedly (al-Ahzab 33:58). Distributing, or threatening to distribute, intimate content is a crime. Steps: screenshot the threats with dates and account names; do not delete the conversation; do not pay or send any more content; report to the police and the Malaysian Communications and Multimedia Commission (MCMC); and use the platform's reporting function. If it is part of domestic violence, a protection order can be sought. Get emotional support from someone you trust or Talian Kasih 15999. See Domestic violence.

61My husband takes my salary and controls all the money, so I have none of my own. Is this allowed?
No. A wife's salary and property are her own, and taking them without her consent or stopping her from using her property is oppression.
Allah states that women have a share of what they earn (an-Nisa' 4:32) and forbids consuming others' wealth unjustly (4:29). Act 303 s.52(1)(h)(iv) lists disposing of a wife's property or preventing her from exercising her legal rights over it as a form of cruelty that can be a ground for fasakh. Extreme financial control also often comes together with emotional abuse. Steps: open an account in your own name that your husband cannot access; keep important documents safe; discuss it with the help of a mediator; and get advice from the religious office or a Syariah lawyer. If there are threats or violence, seek protection. See the question on a wife's salary.

62After a big quarrel, how can the relationship be properly repaired?
Repair needs three things: acknowledging the mistake specifically, putting right its effects, and changing behaviour so it does not happen again.
Allah praises those who, when they do wrong, quickly remember Allah and do not persist in it (Al ʿImran 3:135), and the Prophet ﷺ advised following a bad deed with a good one to wipe it out (Jamiʿ at-Tirmidhi 1987). Steps: wait until both are calm; apologise without "but"; listen to how your spouse was hurt; agree on one concrete change; and do small things that rebuild a sense of safety, such as touch, kind words and time together. Avoid covering a quarrel with gifts without discussing its cause. If the quarrel involved violence, repair begins with safety and professional help, not just an apology. See Persuasion techniques.

63My spouse has suddenly become very strict in religion and is forcing their views on the whole household. How should this be handled?
Appreciate their zeal for religion, but make clear that Islam teaches gentleness and no compulsion; discuss obligatory matters and matters of scholarly difference separately.
Allah says He wants ease, not hardship (al-Baqarah 2:185), and the Prophet ﷺ advised: make things easy, do not make them difficult (Sahih al-Bukhari 6125); he also corrected a Companion who overdid worship to the point of neglecting his family's rights (Sahih al-Bukhari 1975). Work out: is what is being forced an obligation, or one view on a disputed issue; is it delivered with wisdom or with contempt; is it isolating the family from relatives and society? Learn together from recognised teachers approved by the religious authorities. If there are signs of extreme views that justify hatred or violence, seek advice from the religious office. See Schools of law.

64May I secretly record my spouse's quarrels or threats as evidence?
To protect yourself from wrongdoing such as threats or violence, keeping evidence is permitted and often advised; but recording to humiliate or expose your spouse is not permitted.
Allah allows the one who has been wronged to speak of the wrong done to them (an-Nisa' 4:148), and forbids spying and exposing others' faults (al-Hujurat 49:12). So the purpose determines the ruling: a recording kept safely and handed only to the police, a lawyer or the court to obtain protection is different from one shared with family or on social media. Whether a recording is admitted as evidence is for the court to decide. Also keep dated notes, messages and medical reports. Put safety first: do not let the act of recording provoke violence. See the question on keeping evidence.

Surah an-Nisa' 4:148Surah al-Hujurat 49:12Surah al-Ma'idah 5:8
65After a quarrel my spouse took the children away and will not let me see them. What can I do?
While still married, both parents have rights over the children; try negotiating through a mediator first, and if that fails, the Syariah Court can make interim orders on custody and visits.
Allah forbids that a mother or father be harmed on account of their child (al-Baqarah 2:233), and children must not be used as weapons in a quarrel. Act 303 empowers the court to make custody orders and to restrain a child being taken out of Malaysia without consent (s.86, s.105). Steps: record dates and attempts to make contact; ask respected relatives or the religious office for help; and get advice from a Syariah lawyer about an urgent application. If you fear the child will be taken abroad, tell your lawyer at once. Put the children's welfare first; do not snatch them back or argue in front of them. See Custody & lineage.

66We are thinking of living apart for a while to calm down. Is this allowed, and what are the consequences?
It is allowed if both agree and the aim is repair, not leaving the wife suspended without certainty; set the length, maintenance and means of contact clearly.
Allah forbids leaving a wife suspended, neither treated as a wife nor divorced (an-Nisa' 4:129), and tells us to appoint arbiters when a breakdown is feared (an-Nisa' 4:35). While living apart, the marriage continues and maintenance for the wife and children remains obligatory if she leaves with her husband's agreement. Things to agree: the length (for example a few weeks), who looks after the children, a visiting schedule, maintenance, and when you will see a counsellor. Separation without a plan often ends in divorce or a neglected wife. Also avoid starting new relationships or exposing the problems publicly during this time. See Counselling.

67We argue about who should look after our frail elderly parents. How can it be settled fairly?
The duty to care for parents lies with their own children; a spouse helps as a kindness, and the load should be shared fairly among siblings.
Allah commands kindness to parents especially in their old age (al-Isra' 17:23–24). A wife is not legally obliged to care for her in-laws, but her kindness is greatly valued; a husband, for his part, may not put the whole burden of care on his wife so that her rights are neglected (an-Nisa' 4:19). Steps: hold a family meeting with all siblings about rotas, costs and roles; consider a helper, visiting nurses or a day-care centre; and make sure the spouse doing the most caring gets rest. Care for both sides' parents must be weighed fairly. Apply for help from the Social Welfare Department if eligible. See the question on a wife caring for her in-laws.

Lihat kaunseling.
70Selepas pasangan curang, bolehkah kepercayaan dibina semula?
Lihat kaunseling.
74Bagaimana melindungi anak-anak semasa kami menghadapi krisis kecurangan?
Jika anak kelihatan terkesan, dapatkan bantuan kaunselor. Lihat anak-anak.
75Pasangan saya curang secara fizikal. Perlukah saya buat pemeriksaan kesihatan?
Lihat keganasan rumah tangga.
Sahih Muslim, Kitab az-Zakah
Lihat hak wanita.
81Saya baru tahu pasangan menyembunyikan hutang besar. Bagaimana menanganinya?
Lihat kesihatan mental.
83Selepas konflik besar, pasangan menolak keintiman berbulan-bulan. Bagaimana memulihkannya?
Lihat kaunseling.
Surah an-Nisa' 4:128
87Pasangan ketagih permainan video sehingga mengabaikan keluarga.
Lihat keganasan rumah tangga.
Sahih al-Bukhari 6116
91Kami sering bergaduh tentang kerja rumah.
Elakkan mengungkit kesilapan lama setiap kali berbincang. Lihat pembahagian tanggungjawab.
Sahih al-Bukhari 676
92Wang menjadi punca utama pertengkaran kami.
Jaga aib pasangan walaupun hati sedang terluka. Lihat mentua dan ipar.
Surah al-Hujurat 49:10
94Kami lebih banyak bergaduh melalui mesej WhatsApp. Elokkah begitu?
Lihat kaunseling.
Surah al-Hujurat 49:6
97Pasangan enggan mengaku rumah tangga kami bermasalah.
Lihat mendidik keluarga.
Bagaimana mengurusnya?
Tekanan wang menaikkan emosi, jadi akui dahulu bahawa anda berdua sedang berdepan ujian yang sama, bukan menjadi musuh satu sama lain.
Lihat talak.
106Patutkah kami menulis perjanjian bertulis selepas berdamai?
