1One thing to understand first
This page is written for you, not to persuade you. Every protection discussed below — maintenance, rotation of nights, inheritance and your children's documents — starts from one thing: a marriage that has the Syariah Court's permission and is registered.
A contract that fulfils the pillars (wali, two witnesses, ijab and qabul) may be valid in Shariah terms even if unregistered. But in Malaysia, the marriage is not officially recognised until it is registered or validated by the court. Registration does not make a marriage valid or invalid, but it is the legal proof (Act 303 s.34). Without that proof, claims for maintenance, jointly acquired matrimonial property (harta sepencarian) and faraid are hard to make, and your children face document problems.
2Essential questions before saying yes
These six questions must be answered with proof, not promises. If he refuses to answer now, he will not answer after the contract.

3Your rights as a second wife
A second wife is not a "second-class" wife. Every wife has the same full rights as if she were the only wife.
4The risks of marrying without permission, across the border or secretly
An invitation to "marry in Thailand first, register later" is a warning. Marrying abroad does not bypass the law; it only postpones the problem, and those who bear it are usually the wife and children. Official data show the problem is large: in Selangor for 2019–2022, applications to validate polygyny after marrying (1,617) were almost double the applications for permission before marrying (859) (Berita Harian, MAIS data, 7 Mar 2023).

5Conditions you can set in the contract
Conditions in the contract are additional commitments agreed at the time of the contract, beyond the pillars of marriage. The Prophet ﷺ said: "The conditions most deserving of being fulfilled are those by which you make intimacy lawful" (Sahih al-Bukhari 2721; Sahih Muslim 1418).
- Conditions consistent with the contract, for example maintenance, good and fair treatment, are obligatory even if not stated. Writing them down only reinforces them.
- Conditions that benefit the wife, for example her own home in your home state or continuing to work: the Hanbali school regards them as valid and binding; the majority regard the condition as void but the contract as valid.
- An additional taʿliq is the safest route in Malaysia. It must be clearly drafted and certified by the registrar. Check current practice with the state Islamic Religious Affairs Department.
- A void condition: you may not make the divorce of the first wife a condition. This is clearly forbidden (Sahih al-Bukhari 5152).
6Relations with the first wife
The Prophet ﷺ said: "It is not lawful for a woman to ask for her sister (co-wife) to be divorced in order to empty her plate, for she will have what has been decreed for her" (Sahih al-Bukhari 5152). This prohibition covers a new wife who makes the divorce of the existing wife a condition, and an existing wife who pressures the husband to divorce the new wife.
- A co-wife is a sister in faith. The prohibitions on mockery, suspicion, spying and backbiting apply in full (Surah al-Hujurat 49:11–12; Sahih Muslim 2564).
- What is obligatory is not to wrong her; becoming close friends is excellence (ihsan), not an obligation.
- Clear boundaries: do not enter a co-wife's home without permission, avoid contacting the husband on a co-wife's night except in an emergency, and do not show off gifts to hurt her.
- Respect her children. Your children and hers are paternal half-siblings and mahram to one another.
- Social media: avoid jibes and status updates aimed at a co-wife.
7Good signs and danger signs
Not one danger sign means he is a bad person. It means you do not yet have enough information, and this decision is too big to make with insufficient information.

8Where to get help
- The family counselling unit at your state Islamic Religious Affairs Department, and the sulh officer at the Syariah Court. Both are free. See Counselling.
- Free or low-cost legal advice: the Legal Aid Department, the state Syariah Legal Aid Bureau, the Syariah Court advisory unit, or a Syarie lawyer.
- Validation of marriage: if the husband refuses to register, the wife herself can apply to the Syariah Court to validate the marriage.

9Final checklist
