The path from intention to a lawful marriage
The red steps take place in the Syariah Court. The enactments say only “the Court”; the Syariah High Court level rests on Practice Direction No. 14/2006 of the Department of Syariah Judiciary Malaysia (JKSM) (in force from 1 June 2006; the text of this direction has been checked), which directs that polygamy cases under Act 303 s.23 and the same section of the state enactments be tried in the Syariah High Court.

B · Polygyny application
In Malaysia, the application is made to the Syariah Court, not merely to the religious office. The enactments say only “the Court”; the hearing in the Syariah High Court rests on JKSM Practice Direction No. 14/2006 (in force from 1 June 2006; the text of this direction has been checked), which directs that polygamy cases under Act 303 s.23 and the same section of the state enactments be tried in the Syariah High Court. In most States the existing wife will be summoned to be heard; the enactment texts of Perlis and Terengganu do not mention it. In other countries the procedure differs — see Choose a country.
