Polygyny application

The path from intention to a lawful marriage

The red steps take place in the Syariah Court. The enactments say only “the Court”; the Syariah High Court level rests on Practice Direction No. 14/2006 of the Department of Syariah Judiciary Malaysia (JKSM) (in force from 1 June 2006; the text of this direction has been checked), which directs that polygamy cases under Act 303 s.23 and the same section of the state enactments be tried in the Syariah High Court.

Assess yourself firstFinancial ability, existing dependants, and the real reason — the calculator and the four conditions.
Gather documentsFinancial statements, existing marriage certificate, details of dependants and the existing wife's address.
File the applicationCourtTo the Syariah Court of your State, not just the religious office. The enactments say only “the Court”; the hearing in the Syariah High Court rests on JKSM Practice Direction No. 14/2006 (in force from 1 June 2006; the text of this direction has been checked), which directs that polygamy cases under Act 303 s.23 and the same section of the state enactments be tried in the Syariah High Court.
Existing wife is summonedCourtShe is entitled to attend and be heard; the woman to be wedded and her wali may also be summoned. The text of s.23 in Perlis names the applicant only, and s.22 in Terengganu does not mention this summons.
Judge assesses the four conditionsCourtJust or necessary · means · fairness · no darar syarie. All must be met. Section 22 in Terengganu does not list these conditions.
DecisionCourtGranted, or refused. The decision may be appealed under the state Syariah Court procedure.
Only then marry and registerAfter permissionWith the permission order: marriage application, akad, and registration of the marriage at the religious office.
The general shape in most States; the texts of Terengganu (s.22) and Perlis (s.23) differ. Form codes and fees are set by each State.

A · First marriage

  1. Marriage application form (state form; ask the religious office counter for the form's name or code)
  2. Copy of the identity cards of the applicant and the prospective wife
  3. Copy of the wali's identity card
  4. Pre-marriage course certificate / letter of confirmation (SIJIL KURSUS KAHWIN)
  5. Statutory declaration of single / marital status
  6. HIV screening test report (both parties)
  7. Passport-sized photographs
  8. Letter of permission from employer / authority if applicable (e.g. members of the armed forces or police)
  9. Fees prescribed by the state (ask the counter for the current amount)
The pre-marriage course (SIJIL KURSUS KAHWIN) is a requirement in all states. Take it early — it is often the reason applications are delayed.

B · Polygyny application

In Malaysia, the application is made to the Syariah Court, not merely to the religious office. In most States the existing wife will be summoned to be heard; the enactment texts of Perlis and Terengganu do not mention it. In other countries the procedure differs — see Choose a country.

  1. Application form for permission to practise polygyny, to the Syariah Court (in most states: the case code 011 form; details for each state are on the Procedure by state page)
  2. Financial statements: recent payslips, bank statements, EPF (KWSP) statement, list of debts and commitments
  3. Details of existing dependants: wife, children, and anyone who will be affected
  4. Copy of the marriage certificate of the existing marriage
  5. Identity cards of the applicant, the existing wife, and the prospective wife
  6. Address and details of the existing wife — the court will summon her to be heard
  7. Reasons for the application — the "just or necessary" argument
  8. Other supporting documents as directed by the court
The right order: apply for permission first, marry afterwards. Reverse that order and you begin with an offence, a fine and a court record — a fine not exceeding RM1,000 or imprisonment not exceeding 6 months or both in most States (Federal Territories s.123; eleven States s.124) — Terengganu: not exceeding RM2,000 or 1 year or both (s.126); Sarawak: not exceeding RM3,000 or 2 years or both (s.127).
