Polygyny application procedure by state
A practical guide to applying for permission for polygyny at the Syariah High Court: the general flow common across the country, a table of 14 states with verifiable forms, fees and official links, and a printable document checklist.

Key point: Polygyny in Malaysia requires the written permission of the Syariah High Court before the akad, and the judge assesses need, ability, justice and harm to the existing wife. The existing wife is notified and may attend to give her view, and the court may order maintenance (nafkah) and jointly acquired matrimonial property (harta sepencarian) for her.

1Basics: where and under which law
A man who already has a wife must obtain the prior written permission of the Syariah Court before a new akad nikah. The provision is in each state's Islamic family law act or enactment, for example Act 303 s.23, Selangor Enactment 2003 s.23, Pahang Enactment 2005 s.23, Sarawak Ordinance 2001 s.21 and Terengganu Enactment 2017 s.22. - Court: the application is heard in the Syariah High Court (JKSM Practice Direction No. 14/2006, in force 1 Jun 2006). JAKESS Selangor states the same: polygyny cases fall within the jurisdiction of the Syariah High Court.
- State: file in the state where you are resident. If the existing wife lives in another state, the summons or notice must be served outside the jurisdiction through a separate application (JKSNT Terengganu; JKSN Kedah).
- The wife's consent: the wife's consent is not a legal requirement. According to the JAKESS FAQ, the wife is notified and may attend, and if she attends, the judge will ask whether she agrees. JKSM states that the wife's consent is taken into account by the court as an additional fact.
- Case code: most states use the case code 011 for permission for polygyny. For example, JAKESS tells applicants to look for the form with "case code 011", Terengganu case numbers take the form 11100-011-…, and the Perak form is named "011 Kebenaran Poligami".
2General flow: 10 steps
- Check your own eligibility against the four conditions of s.23(5) (Act 303: s.23(4)): just or necessary, able, able to be just, and no harm recognised by Syariah law (darar syarie) to the existing wife. The court looks at net salary and actual commitments (see Finances of two households).
- Obtain the form from the state Syariah Judiciary Department portal or at the counter. Some states use a summons and statement of claim (Pahang, Perak), and some use a notice of application and affidavit (Terengganu, Johor, Kedah).
- Complete the pleadings as required by s.23(4) (Act 303: s.23(3)): the grounds why the marriage is just or necessary, income, commitments and dependants, the number of dependants after the marriage, and whether the wife's consent has been obtained. The Pahang and Perak forms also ask for proposed maintenance for each wife and child and a proposed rotation of nights.
- Prepare copies in the number set by the state (for example 1 original and 2 copies in Selangor, 4 copies in Perak, 5 sets in Pahang). Pahang requires forms to be typed; handwriting in pen is not allowed.
- Register at the Syariah High Court counter. Affidavits and exhibits are affirmed before the Registrar or Assistant Registrar. The case is registered in the e-Syariah system, the fee is paid and a receipt issued (JKSN Johor work process). Kedah does not accept registration by post.
- A mention date is usually given on the same day. In Selangor, the mention is usually set within 21 days or more. In Kedah, the first mention is set within 30 working days.
- Service of the summons or notice on the existing wife, and in some states also on the prospective wife and her wali (guardian), since Pahang names them as Defendants 2 and 3. Johor may also issue a notice to attend Majlis Sulh (mediation).
- Hearing in chambers. The judge hears the applicant, the wife, the prospective wife and the wali (guardian). Bring original documents and witnesses who can support your ability.
- Decision and order. In Selangor, the official order can be obtained within 30 days after the case is approved and the order is requested. A party who is dissatisfied may file a notice of appeal within 14 days of the date of the decision (JKSN Johor).
- After approval: take the order to the District Islamic Religious Affairs Office to apply for the nikah and registration (JAKESS). Do not perform the akad before obtaining permission to marry from the registrar.
3Table of 14 states: forms, fees, links
All applications are heard in the Syariah High Court (JKSM PD 14/2006). The Court column shows the headquarters of the state Syariah Judiciary Department according to the JKSM directory. Applications may also be filed at the relevant district Syariah High Court.

4Document checklist (printable)
This list combines the documents commonly requested by JAKESS (Selangor), JKSP (Pahang), JKSN Perak, JKSNT (Terengganu) and JKSN Kedah. Tick each item, then check against your state's official list.

5Police, armed forces and APMM: additional letters
- Police (PDRM) and armed forces (ATM): the judge must ensure that a letter of permission from the Commanding Officer or the Inspector-General of Police is attached before deciding the application (JKSM Practice Direction No. 2/2007, in force 15 Jun 2007).
- Armed forces: Perak KHS Practice Direction 12/2023 lists "Surat pengakuan anggota tentera (BAT D 196 – AA JKSM No 10 Tahun 2011)" (declaration letter of a member of the armed forces). JKSM Practice Direction No. 1/2017 further provides that family proceedings involving spouses of armed forces members are handled by the Kor Agama Angkatan Tentera (KAGAT) first before being filed in court.
- APMM: Maritime Enforcement officers and other ranks of the APMM must submit the APMM Application Form for Permission for Polygyny confirmed as notified to the Director-General of the APMM (JKSM Practice Direction No. 1/2019, 23 Dec 2019).
6At the hearing: what is assessed
- The judge assesses all four conditions of s.23(5) cumulatively. Decided cases are on Court cases and Polygyny in Malaysia.
- The existing wife may attend and give her view. If she does not attend, the court may proceed with the hearing once service is proved by an affidavit of service (Johor process).
- Common reasons applications fail: insufficient net income after deductions, the applicant being in a debt management programme (AKPK), no witnesses to support ability, or the applicant not attending on the hearing date. In one case at the Terengganu Syariah High Court (2019), the application was struck out under s.121(1)(c) of the Syariah Court Civil Procedure (Terengganu) Enactment 2001 for these reasons.
7After approval: nikah and registration
- Collect the written order once sealed. In Selangor, the order can be obtained within 30 days of approval on request.
- Apply for permission to marry at the District Islamic Religious Affairs Office or the marriage registrar, bringing the order (JAKESS). In Perak, if an application for permission to marry under s.18 is needed for a couple intending a polygynous marriage, it is heard by the same Syariah High Court judge who heard the s.23 application (Perak KHS PD 7/2024).
- Note the period of validity. In Perak, an order permitting polygyny may be extended up to 180 days from the date of the order through an ex parte application supported by affidavit. After that period, a fresh application must be filed (Perak KHS PD 9/2023). Period in other states: (to be verified).
- Akad nikah and registration follow that state's usual procedure (see Akad). Keep the marriage certificate. The new wife and the existing wife are both entitled to claim their rights in court, including maintenance (nafkah) and rotation of nights (giliran).
8If already married without permission
The procedure is different: an application for confirmation and registration of the marriage, and possible prosecution (see Unofficial marriage and Secret polygyny). Two state examples:
- Pahang provides a "Borang Permohonan Pengesahan Perintah Nikah Poligami" (application form to confirm a polygynous marriage order) at the Syariah High Court.
- Perak (KHS PD 12/2023) lists the documents for confirmation: application and affidavit; covering letter from the KPNCR or PNCR; copy of identity card; confirmation of residence; marriage certificate; confirmation of the wali's authority; documents of the marriage witnesses; passport or border pass; letter from the consulate or religious council of the country concerned; police or armed forces letter (if relevant); proof of marriage. According to Perak KHS PD 3/2024, a woman may only file confirmation of a polygynous marriage herself in certain circumstances, for example where the husband refuses to give the wife her rights, is incapacitated, or has died.
