Polygyny application procedure by state
A practical guide to applying for permission to practise polygamy in the Syariah Court: the general flow in most States, with the exceptions of Terengganu and Perlis, a table of the 14 States with forms, fees and official links that could be verified, and a printable document checklist.
General information, not legal advice or a fatwa. Disclaimer
- Understanding the four conditions of s.23(5) that the judge assesses cumulatively
- Knowing the role and rights of the existing wife at the hearing
- Identifying the court and official documents in the state where you are resident
Key point: Polygyny in Malaysia requires the written permission of the Syariah High Court before the akad, and the judge assesses need, ability, justice and harm to the existing wife. The existing wife is notified and may attend to give her view, and the court may order maintenance (nafkah) and jointly acquired matrimonial property (harta sepencarian) for her.
- Note the court and the official portal of your state's Syariah Judiciary Department from the table of 14 states
- Husbands: list your net salary, debts and actual commitments before assessing your own ability
- Wives: know that you may attend and apply for orders for maintenance (nafkah) and jointly acquired matrimonial property (harta sepencarian)

1Basics: where to apply and which law applies
A man who is still married must obtain the prior written permission of the Syariah Court before a new akad nikah. The provision is in the Islamic family law act or enactment of each State, for example Act 303 s.23, Selangor Enactment 2003 s.23, Pahang Enactment 2005 s.23, Sarawak Ordinance 2001 s.21 and Terengganu Enactment 2017 s.22. The legal details for each State are on the page Polygamy in Malaysia, and the text of each enactment held is at State enactments.
- Court: the Islamic family law enactments say only “Court”, which s.2 defines as the Syariah Subordinate Court or the Syariah High Court, as the case may be (Terengganu s.22 says “Hakim Syarie”). Polygamy applications are heard in the Syariah High Court under Practice Direction No. 14/2006 of the Department of Syariah Judiciary Malaysia (JKSM), in force from 1 June 2006, which directs that polygamy cases under Act 303 s.23 and the same section of the state enactments be tried in the Syariah High Court. The Selangor Syariah Judiciary Department (JAKESS) states that polygamy cases fall within the jurisdiction of the Syariah High Court (MTS).
- State: file in the state where you are resident. If the existing wife lives in another state, the summons or notice must be served outside the jurisdiction through a separate application (according to the State Syariah Judiciary Departments (JKSN) of Terengganu and Kedah).
- Wife’s consent: the wife’s consent is not a legal condition. According to the JAKESS FAQ, the wife is notified and may attend, and if she attends, the judge will ask whether she agrees. JKSM states that the wife’s consent is taken into account by the court as an additional fact. In the enactment texts, the requirement to summon the existing wife is written in Act 303, s.23 of ten States and s.21 of Sarawak; the text of s.23 in Perlis names the applicant only, and s.22 in Terengganu does not mention it.
- Case code: the Syariah Court gives each type of case a code number, and most states use the case code 011 for permission for polygyny. It shows the type of case, not your own case number. For example, JAKESS tells applicants to look for the form with "case code 011", Terengganu case numbers take the form 11100-011-…, and the Perak form is named "011 Kebenaran Poligami".
2General flow: 10 steps
- Check your own eligibility against the four conditions of s.23(5) (Act 303: s.23(4); Sarawak: s.21(5)). Terengganu differs: s.22 of the 2017 Enactment lists no conditions and requires only the written permission of the Syarie Judge. The four conditions are: just or necessary, means, ability to be fair, and no darar syarie (harm to religion, life, body, mind, property or dignity) to the existing wife. The court looks at net salary and actual commitments (see Two-household finances).
- Obtain the form from the state Syariah Judiciary Department portal or at the counter. Some states use a summons and statement of claim (Pahang, Perak), and some use a notice of application and affidavit (Terengganu, Johor, Kedah).
- Complete the pleadings (the written documents that set out your claim) as required by s.23(4) (Act 303: s.23(3); Sarawak: s.21(4); there is no equivalent provision in s.22 of Terengganu): the reasons the marriage is just or necessary, income, commitments and dependants, the number of dependants after the marriage, and whether the wife’s consent has been obtained. The Pahang and Perak forms also ask for a proposed maintenance for each wife and child and a proposed overnight rotation.
- Prepare copies in the number set by the state (for example 1 original and 2 copies in Selangor, 4 copies in Perak, 5 sets in Pahang). Pahang requires forms to be typed; handwriting in pen is not allowed.
- Register at the Syariah High Court counter. Affidavits and exhibits are affirmed before the Registrar or Assistant Registrar. The case is registered in the e-Syariah system, the fee is paid and a receipt issued (JKSN Johor work process). Kedah does not accept registration by post.
- A mention date (the first time the case is called in court, before the hearing) is usually given on the same day. In Selangor, the mention is usually set within 21 days or more. In Kedah, the first mention is set within 30 working days.
- Service of the summons or notice on the existing wife. By the enactment texts, s.23(6) in ten States and s.21(6) in Sarawak require service on each existing wife and the woman to be wedded; Act 303 s.23(5) names the existing wife only; the Perlis and Terengganu texts have no service subsection. Pahang names the woman to be wedded and her wali as Defendants 2 and 3. Johor may also issue a notice to attend a Majlis Sulh (a conciliation session at the court, before the hearing).
- Hearing in chambers, that is, in private in the judge’s room and not in open court. The judge hears the applicant, the wife, the woman to be wedded and the wali (in Perlis and Terengganu this requirement does not come from the enactment text). Bring the original documents and witnesses who can support your means.
- Decision and order. In Selangor, the official order can be obtained within 30 days after the case is approved and the order is requested. A party who is dissatisfied may file a notice of appeal within 14 days of the date of the decision (JKSN Johor).
- After approval: take the order to the District Islamic Religious Affairs Office to apply for the nikah and registration (JAKESS). Do not perform the akad before obtaining permission to marry from the registrar.
3Terms on the form: what each one means
Court forms and counters use terms seldom heard outside a court. These are the ones you will meet most often in a polygamy application.
| Term | What it means | Where you meet it |
|---|---|---|
| Case code 011 | The Syariah Court gives every type of case a code number. In most states, 011 is the code for an application for permission to practise polygamy. It is not your case number — it shows the type of case. | In the name of the form (for example, Perak's form is called “011 Kebenaran Poligami”), and in the middle of your case number (for example, a Terengganu case number has the form 11100-011-…). JAKESS (Selangor) tells applicants to look for the form with “kod kes 011”. |
| Case number | The unique number given to your application when it is registered. Quote it every time you deal with the court. | On the registration receipt and every court document after that. |
| Affidavit (or ikrar) | A written statement that you confirm to be true on oath before the court Registrar. Making a false statement in an affidavit is an offence. | Attached to the application. See the example below. |
| Exhibit (or attachment) | A supporting document referred to in the affidavit — marriage certificate, payslips, bank statements — each one marked (Attachment A, B, C). | Fastened behind the affidavit and affirmed together with it. |
| Summons / notice of application | The document that starts the case and calls the parties to attend court. Different states use different forms of it. | The first form you fill in; a copy is served on the existing wife. |
| MTS / MRS | Syariah High Court / Syariah Subordinate Court. The enactments say only “Court”, which s.2 defines as either of these two levels, as the case may be. Polygamy applications are heard in the MTS under JKSM Practice Direction No. 14/2006 (in force from 1 June 2006), which directs that polygamy cases under Act 303 s.23 and the same section of the state enactments be tried in the Syariah High Court. | At the head of the form and in the state table. |
| Registrar | The court officer who receives, checks and registers the case, and before whom the affidavit is affirmed. | At the court's registration counter. |
| e-Syariah | The Syariah Court computer system that records the registration and progress of every case. | Your case is registered in it at the counter. |
| Mention (sebutan) | The first date on which the case is called in court — to make sure the documents are complete and all parties have received the summons — before a hearing date is fixed. | The date is printed on the summons or notice. |
4Example applicant's affidavit (illustration)
An affidavit is the document in which the applicant states, on oath, the facts the court needs to assess the application. For the Federal Territories, Act 303 s.23(3) lists what must be stated in that declaration: the grounds on which the proposed marriage is just or necessary; the applicant's present income; particulars of his financial commitments, obligations and liabilities; the number of his dependants, including those who will become his dependants as a result of the marriage; and whether the consent or views of the existing wife have been obtained.
The example below shows the form of an affidavit covering all five matters. The names and figures are invented.
IN THE STATE OF [STATE]
CASE NO.: [filled in by the court]
- I am the Applicant in this application and the facts in this affidavit are within my own knowledge.
- I married [WIFE'S NAME], NRIC No. [..], on [date] and that marriage still subsists. We have [number] children. A copy of the marriage certificate is attached as Attachment A.
- I apply for permission to marry [PROPOSED WIFE'S NAME], NRIC No. [..], whose status is [never married / divorcee / widow], of [address].
- (Grounds) The proposed marriage is just or necessary because: [state your real reasons, clearly and honestly].
- (Income) My present income is RM [amount] a month, from [employment / business]. My payslips for the last three months are attached as Attachment B.
- (Commitments and financial obligations) My monthly commitments are: home financing RM [..]; vehicle financing RM [..]; maintenance of my wife and children RM [..]; others RM [..]. The related statements are attached as Attachment C.
- (Dependants) I now support [number] people, namely [wife, children, parents]. After the proposed marriage, my dependants will number [number].
- (Existing wife) The consent or views of my existing wife on this proposed marriage [have been obtained / have not been obtained]. [State briefly what her view is.]
- I state that I am able to support all my wives and dependants as required by Hukum Syarak, and will accord equal treatment to all my wives.
- I ask that this application be allowed.
before me,
Registrar / Assistant Registrar
Syariah High Court [place]
The five matters required by s.23(3) are paragraphs 4 to 8. Paragraph 9 touches on two matters the court must be satisfied of before granting permission — the ability to provide and equal treatment (s.23(4)(b) and (c)) — but the court assesses them from evidence, not from that statement alone.
5Table of 14 states: forms, fees, links
This table lists each state's Syariah High Court (MTS), because polygamy applications are heard in the MTS under JKSM Practice Direction No. 14/2006. That practice direction (dated 12 April 2006, in force from 1 June 2006) does direct that polygamy cases under Act 303 s.23 and the same section of the state enactments be tried in the Syariah High Court, even though the enactments themselves say only “Court”; confirm at the counter. The Court column shows the head office of each state's Syariah Judiciary Department according to the JKSM directory. Applications may also be filed at the relevant district MTS.

7Police, armed forces and APMM: additional letters
- Police (PDRM) and armed forces (ATM): the judge must ensure that a letter of permission from the Commanding Officer or the Inspector-General of Police is attached before deciding the application (JKSM Practice Direction No. 2/2007, in force 15 Jun 2007).
- Armed forces: Perak Chief Syarie Judge (KHS) Practice Direction 12/2023 lists "Surat pengakuan anggota tentera (BAT D 196 – AA JKSM No 10 Tahun 2011)" (declaration letter of a member of the armed forces). JKSM Practice Direction No. 1/2017 further provides that family proceedings involving spouses of armed forces members are handled by the Kor Agama Angkatan Tentera (KAGAT) first before being filed in court.
- APMM: Maritime Enforcement officers and other ranks of the APMM must submit the APMM Application Form for Permission for Polygyny confirmed as notified to the Director-General of the APMM (JKSM Practice Direction No. 1/2019, 23 Dec 2019).
8At the hearing: what is assessed
- The judge assesses all four conditions of s.23(5) cumulatively (Act 303: s.23(4); Sarawak: s.21(5)). Section 22 in Terengganu lists no conditions. Decided cases are at Court cases and Polygamy in Malaysia.
- The existing wife may attend and give her views. The texts of Act 303, s.23 of ten States and s.21 of Sarawak require the court to summon her; the Perlis and Terengganu texts do not mention it. If she does not attend, the court may proceed with the hearing once service is confirmed by an affidavit of service (the Johor process).
- Common reasons applications fail: insufficient net income after deductions, the applicant being in a debt management programme of the Credit Counselling and Debt Management Agency (AKPK), no witnesses to support ability, or the applicant not attending on the hearing date. In one case at the Terengganu Syariah High Court (2019), the application was struck out under s.121(1)(c) of the Syariah Court Civil Procedure (Terengganu) Enactment 2001 for these reasons.
9After approval: nikah and registration
- Collect the written order once sealed. In Selangor, the order can be obtained within 30 days of approval on request.
- Apply for permission to marry at the District Islamic Religious Affairs Office or the marriage registrar, bringing the order (JAKESS). In Perak, if an application for permission to marry under s.18 is needed for a couple intending a polygynous marriage, it is heard by the same Syariah High Court judge who heard the s.23 application (Perak KHS PD 7/2024).
- Note the period of validity. In Perak, an order permitting polygyny may be extended up to 180 days from the date of the order through an ex parte application (made by the applicant alone, without calling the other party) supported by affidavit. After that period, a fresh application must be filed (Perak KHS PD 9/2023). Period in other states: (check with the state court).
- Akad nikah and registration follow that state's usual procedure (see Akad). Keep the marriage certificate. The new wife and the existing wife are both entitled to claim their rights in court, including maintenance (nafkah) and rotation of nights (giliran).
10If already married without permission
The procedure is different: an application for confirmation and registration of the marriage, and possible prosecution (see Unofficial marriage and Secret polygyny). Two state examples:
- Pahang provides a "Borang Permohonan Pengesahan Perintah Nikah Poligami" (application form to confirm a polygynous marriage order) at the Syariah High Court.
- Perak (KHS PD 12/2023) lists the documents for confirmation: application and affidavit; covering letter from the Chief Registrar or Registrar of Marriages, Divorces and Ruju' (KPNCR or PNCR); copy of identity card; confirmation of residence; marriage certificate; confirmation of the wali's authority; documents of the marriage witnesses; passport or border pass; letter from the consulate or religious council of the country concerned; police or armed forces letter (if relevant); proof of marriage. According to Perak KHS PD 3/2024, a woman may only file confirmation of a polygynous marriage herself in certain circumstances, for example where the husband refuses to give the wife her rights, is incapacitated, or has died.
