What does shiqaq mean in Islamic family law?
Shiqaq is a prolonged and serious dispute between husband and wife that makes living together difficult, and it is the term used in an-Nisa' 4:35.
The verse begins: "And if you fear a breach (shiqaq) between the two, then appoint an arbiter (hakam) from his family and an arbiter from her family." In Malaysia, when the court finds that shiqaq is continuing, it can appoint arbiters (hakam) under the state enactment. Shiqaq differs from nushuz: nushuz usually refers to one particular party who is defiant, whereas shiqaq is a two-way conflict where it is unclear who is the cause.
