What is the Conciliatory Committee (Jawatankuasa Pendamai) in a divorce application?
The Conciliatory Committee is a committee appointed by the court to try to reconcile husband and wife when one party does not agree to the divorce application.
In the Federal Territories, it is provided for in s.47 of Act 303; other states have similar provisions in their own Enactments. The committee is usually made up of a religious officer as chair and representatives of the husband and wife, preferably close relatives. They are given a set period to seek reconciliation; if they fail, the committee informs the court and the application proceeds. This process puts into practice the spirit of an-Nisa' 4:35.
