Isteri boleh memfailkan tuntutan nafkah di Mahkamah Syariah, dan mahkamah boleh memerintahkan suami membayar nafkah semasa serta tertunggak. Nafkah zahir (makanan, pakaian, tempat tinggal) adalah wajib ke atas suami mengikut kemampuannya (2:233, 65:7). Sebelum ke mahkamah, cuba berbincang atau dapatkan khidmat kaunseling dan sulh. Jika suami ingkar perintah mahkamah, tindakan penguatkuasaan boleh diambil, termasuk potongan gaji; di sesetengah negeri ada Bahagian Sokongan Keluarga yang membantu. Tidak memberi nafkah dalam tempoh tertentu juga boleh menjadi asas fasakh mengikut enakmen negeri. Hindun dibenarkan mengambil secukupnya dari harta suami yang kedekut (Sahih al-Bukhari 5364). The husband has not paid maintenance for months. What action can be taken?

The wife can file a maintenance claim at the Syariah Court, and the court can order the husband to pay current maintenance and arrears.
Material maintenance (nafkah zahir: food, clothing, accommodation) is obligatory on the husband according to his means (2:233, 65:7). Before going to court, try discussing it or seek counselling and mediation (sulh). If the husband defies a court order, enforcement action can be taken, including salary deduction; some states have a Family Support Division (Bahagian Sokongan Keluarga) that helps. Not providing maintenance for a certain period can also be grounds for fasakh under state enactments.
