Q&A › Divorce, ʿiddah & rujuk

🚪 Divorce, ʿiddah & rujuk · #132

My husband did not attend court even though he was summoned. Will my case be left hanging?

Not necessarily; if the summons was properly served, the court has ways to proceed with the case even if your husband does not attend. The first thing is to make sure the summons reached him according to procedure, because the court needs to be satisfied that he was notified. Keep proof of service of the summons, and give the court your husband's latest address or details if you know them. If he is hard to trace, the court may allow another method of service. Keep attending every mention date and bring your witnesses and documents. This process demands patience, but it does not end just because one party goes silent. Refer to the syariah Court procedure page.
