Q&A › Divorce, ʿiddah & rujuk

🚪 Divorce, ʿiddah & rujuk · #130

My husband does not pray at all even after being advised. Can I apply for divorce on that ground?

Abandoning prayer is a major sin, but whether it is enough as a ground for divorce in court depends on the circumstances and your state's law. Before it reaches that point, try a different approach. Invite him to pray together without sarcasm, ask for help from someone he respects, and pray for him consistently. Allah says: “Enjoin prayer on thy people, and be constant therein” (Surah Taha 20:132). If this comes with other problems such as neglected maintenance (nafkah) or harmful behaviour, the overall picture is different. To assess your legal options, including khul', see a syarie lawyer or an officer at the Syariah Court. See also women's rights.
