Khul', fasakh or ta'liq divorce: how do I know which route suits me?

The choice depends on the root of the problem and the evidence you have, and on whether your husband is willing to cooperate. Ta'liq divorce suits a case where your husband has breached the ta'liq pronouncement read at the marriage, for example not providing maintenance for a certain period. Fasakh suits a case where there is a recognised ground, such as harm or certain illnesses, and you are able to prove it. Khul' suits a case where you can no longer continue the marriage and are prepared to pay tebus talak (payment for release), even if your husband is not at fault. Start by writing a list of the real problems and the evidence you have. Take that list to the Syariah Court's advisory counter or see a syarie lawyer to choose the strongest route.
