Q&A › Divorce, ʿiddah & rujuk

🚪 Divorce, ʿiddah & rujuk · #119

My husband has agreed to divorce me if I drop all my claims. Should I agree?

Do not agree in a hurry; first understand the value of every right you would be giving up, especially those involving the children. A wife may offer something as a tebus talak (payment for release, khul'), and that is permitted. But child maintenance is the child's right, not yours to give up, so do not include it in the offer. List what is at stake: iddah maintenance, mut'ah, jointly acquired property (harta sepencarian) and any outstanding mahr. Then decide which you are willing to give up for your freedom, and which you are not. Make sure any agreement is recorded at the Syariah Court, not just a verbal promise. A sulh officer can help you reach a fair agreement without a long trial. Read also tebus talak.
