Q&A › Divorce, ʿiddah & rujuk

🚪 Divorce, ʿiddah & rujuk · #133

We have agreed to divorce amicably. Do I still need a syarie lawyer, or can I handle it myself in court?

It is not compulsory, but a syarie lawyer is very helpful if your case involves disputes over hadhanah (custody), property or fasakh. For a simple divorce by mutual consent, many people handle it themselves with help from the Syariah Court counter. But when the other party is represented by a lawyer, or the property and children issues become complicated, professional advice protects your rights. If cost is a worry, ask the Legal Aid Department about your eligibility, or find a legal clinic that offers advice. Before meeting a lawyer, prepare a short timeline and the main documents so that the consultation time is well used. Also ask for a cost estimate from the start. Read the explanation at court checklist.
