We built a business together. How do we separate it fairly after divorce?
Start by getting a true picture of the business's value, then choose whether to sell it, have one party buy it, or carry on together under a new agreement. Gather the company registration documents, accounts, stock, assets and business debts. If necessary, appoint an independent accountant to value the business so that neither side feels cheated. Keep business decisions separate from the emotions of the divorce; set specific meetings with a clear agenda. Allah says: “When ye deal with each other, in transactions involving future obligations in a fixed period of time, reduce them to writing” (Surah al-Baqarah 2:282). The principle is the same: write down every agreement and record it in court. See matrimonial property (harta sepencarian).
