A husband and wife died at the same time in an accident. Who inherits from whom?
If it cannot be established who died first, the two of them do not inherit from each other. The husband's estate is divided among his surviving heirs, and the wife's among her own heirs, as if each had died without a spouse. If there is clear evidence that one died earlier, even by a moment, the one who died later inherits from the earlier one, and that share then passes on to his or her own heirs. This situation is very heavy for the family left behind, especially if there are young children. Put the care of the children first. Then gather the medical and police reports on the time of death, as the Syariah Court will assess that evidence when determining the heirs. See preparing for death.
