Our house is in the joint names of husband and wife. If my husband dies, does the whole house become mine?

Not necessarily; your own portion remains yours, but your husband's portion becomes part of his estate and is divided by faraid. Many couples assume joint names on the title mean the surviving spouse takes everything. In faraid, the deceased's portion is still divided among all his heirs, including you, the children and possibly his parents. If you want the surviving spouse to be better protected, plan it while both of you are still healthy. For example, the husband can give his portion to you as a gift (hibah) with valid documents and complete handover. Also check whether the home loan is covered by takaful. Discuss the best arrangement with a syarie lawyer or a trust company. See family finances.
