Which heirs are certain to receive a share of the estate and can never be excluded at all?

There are six heirs who are never fully excluded: the husband or wife, son, daughter, father and mother. Their shares may increase or decrease depending on who else is still alive, but they are not cut out entirely as long as there is no impediment such as a difference of religion. Other heirs, such as siblings, grandfathers or uncles, can be excluded by closer heirs. For example, the deceased's siblings do not inherit if the deceased left a son or a father. A useful first step is to list all the deceased's family members who were alive on the day of death. Bring that list when applying for a faraid certificate at the Syariah Court. See faraid basics.
