My husband has been missing for years without any news. What happens to his property?

The property of a missing person cannot be divided as an estate until his death has been decided by the court. As long as there is no decision, his property remains his and must be looked after, not divided up by the family. The Syariah Court can make a declaration of presumed death after assessing how long he has been missing and the efforts to find him. Only then is the estate administered and the wife observes her waiting period (iddah). For you as his wife, being left in limbo like this is exhausting. Start by keeping records of the police report and every search effort. Then get advice at the Syariah Court about your options, including maintenance (nafkah) and judicial dissolution (fasakh). See abandoned by a husband.
