What is a faraid certificate, and why do we need to apply for one?

A faraid certificate is a Syariah Court document that lists the deceased's heirs and the share due to each one. This document is usually required by those who distribute the estate, such as the Estate Distribution Unit (Unit Pembahagian Pusaka), Amanah Raya Berhad or the civil court, so that the division follows Islamic law. To apply, the family usually brings the death certificate, the heirs' identity documents, the marriage certificate and the children's birth certificates. Make sure all the deceased's wives and children are listed honestly, including those living in another home. Hiding an heir is not only unjust but can also cause the division to be reopened later. Check the latest list of documents at your state Syariah Court before you go. See managing an estate.
