Is shared custody, where the child lives alternately in the mother's and father's homes, allowed in Islam?
Parents can agree to it if it is truly good for the child, even though classical fiqh gives the mother priority in custody (hadhanah) of a young child. The aim of hadhanah is the child's welfare, not victory for either parent. An alternating arrangement suits families where the homes are close, school is not disrupted, and the two of you can communicate well. For a child who is still young or finds it hard to adjust, moving back and forth too often may be tiring. Write down the schedule, consistent house rules, and how major decisions will be made. Record the agreement at the Syariah Court so it is clear and enforceable. Review it as the child grows. Read also hadhanah (custody).
