Q&A › Polygyny: the law

🏛️ Polygyny: the law · #95

I once married a second time without permission and now want to put things right. Where do I start?

Start by going to your state Islamic religious affairs office and being upfront about what happened. Usually, the marriage must be checked as to whether it is valid under Islamic law, and you may face action for polygyny without permission before it can be registered. Bring all the documents you have: the marriage certificate and the details of the marriage officer, wali and witnesses. Delaying this only prolongs the risk to your second wife and children, especially in matters of maintenance, inheritance and birth registration. Also tell your first wife if she does not yet know; that honesty is part of repentance. A syarie lawyer can guide you through the process. See unofficial marriage.
