Q&A › Polygyny: the law

🏛️ Polygyny: the law · #108

I am a second wife, and my husband now wants to marry again. Will I also be called to court?

Yes, usually all existing wives are called to be heard, including you as the second wife. Your position in this process is the same as the first wife's: you can state your view, object, or ask for conditions on maintenance (nafkah) and the rota (turn of nights). Your experience is very valuable before the judge, because you know how fair your husband has been so far. Prepare an honest record of the turns you have received, maintenance, and attention to the children. You do not need to compete with the first wife; each of you has the right to be heard. If needed, get advice from a syarie lawyer. See applying for a third wife.
