Q&A › Polygyny: the law

🏛️ Polygyny: the law · #111

I want to remarry my ex-wife, while I currently have another wife. Do I need polygyny permission?

Yes; if her iddah (waiting period) has ended, this is a new marriage, and because you are currently married, it requires the Syariah Court's permission. The fact that she was once your wife does not exempt you from this procedure. Your current wife will be called to be heard, and your ability to support two homes will be assessed like any other application. Talk honestly with your current wife before filing; the name of an ex-wife can stir deep worries. Also make sure the cause of the earlier separation has truly been resolved, so that history does not repeat itself and the children are not hurt again. See remarriage.
