🤝 Existing wife & prospective wife · #200
As a second wife, can I claim the house my husband bought with his first wife before we married?
Usually not, because harta sepencarian is assessed by the period and contributions of your own marriage. Act 303 s.2 defines harta sepencarian as property jointly acquired by husband and wife during the subsistence of the marriage. A house the husband acquired with his first wife before you married belongs to the first marriage; it does not become your harta sepencarian just because he married again. You can claim on assets acquired during your marriage, according to your contribution. The first wife can also claim on assets from the same period if she contributed too. The court assesses every claim on the evidence. See Harta sepencarian.
