Conditions in the contract (shurut) & taʿliq divorce

Couples may place additional conditions in the marriage contract, including a condition that the husband will not take another wife. Whether such a condition is valid differs by school — and in Malaysia, the taʿliq pronouncement gives the wife a route to protection recognised by the courts.

📘 What you will learn

Key point: Couples can be open about their expectations through conditions or an additional taʿliq, but the effect differs by school and by how it is drafted. In Malaysia, the taʿliq pronouncement in the marriage certificate gives the wife a route to protection recognised by the courts.

This week's practice
  1. Read the taʿliq pronouncement printed in your marriage certificate together with your spouse
  2. Bride and groom: discuss expectations about work, home and polygyny before the contract
  3. Ask your state's Marriage Officer about current practice on additional taʿliq

Process

Claiming taʿliq divorce at the Syariah Court

Gather evidenceMarriage certificate (taʿliq wording), record of non-maintenance, medical or police reports, and witnesses.
File the applicationConfirmation of taʿliq divorce at the district Syariah Subordinate Court where you reside.
Oath and evidenceThe court hears the wife and witnesses; the case may proceed if the husband fails to attend after valid notice.
Iwadh paymentThe wife pays the small sum named in the wording (e.g. RM1) in court.
Confirmation orderThe talaq is confirmed and registered; the wife may claim ʿiddah maintenance, mut'ah, jointly acquired property and hadhanah.

1What are conditions in the marriage contract?

Conditions in the contract (ash-shurut fi an-nikah) are additional commitments agreed by husband and wife (or the wali) at the time of the contract, beyond the pillars of marriage. For example: the wife continues working, is not moved from her home state, the mahr is paid on a schedule, or the husband does not marry another wife.

The basis is the saying of the Prophet ﷺ: "The conditions most deserving of being fulfilled are those by which you make intimacy lawful." (Sahih al-Bukhari 2721; Sahih Muslim, Kitab an-Nikah). And the hadith: "Muslims are bound by their conditions, except a condition that forbids what is lawful or makes lawful what is forbidden" (narrated by at-Tirmidhi; graded hasan sahih by at-Tirmidhi).

Conditions differ from taʿliq: a condition is a promise, whereas a taʿliq is a pronouncement of talaq suspended on some event — if that event happens, the talaq takes effect (or the wife may apply for the talaq to be pronounced).

2Three types of condition

In general the scholars divide conditions into three categories — valid, disputed and void — and some void conditions also invalidate the contract (the fourth row):

TypeExampleEffect
Valid — consistent with what the contract requiresThe husband provides maintenance, treats her well, is fairObligatory even if not mentioned; stating it only reinforces it
Disputed — benefits the wifeNo polygyny, not moving away from the wife's home town, the wife may continue studying/workingHanbali: valid and binding; the majority: the condition is void but the contract is valid
Void — contrary to the purpose of the contractNo maintenance at all, no intimacy, no inheritance rights, the wife is given no turn in the rotationThe condition lapses; according to the majority the contract remains valid
Invalidates the contractTemporary marriage (nikah mutʿah), a condition of talaq after a set period, syighar (exchanging daughters or sisters in place of mahr), a muhallil conditionThe contract is void according to the majority
Shafi'i school: if the void condition affects the mahr (for example a condition of no maintenance), the stated mahr lapses and is replaced by the customary mahr (mahr mithl).

3The position of the four schools

  • Hanbali — the most accepting of conditions. Any condition that gives the wife a lawful benefit and does not make the forbidden lawful is valid and binding. If the husband breaches it, the wife has the right to choose judicial dissolution (fasakh) (dissolving the marriage). This view is based on the ruling of Sayyidina Umar r.a.: "Rights are bounded by conditions" (narrated by al-Bukhari in ta'liq form).
  • Hanafi — such a condition is not binding as part of the contract; however, if the mahr was fixed on the basis of that condition and the husband breaches it, the wife is entitled to the customary mahr (mahr mithl).
  • Maliki — such a condition is disliked (makruh) and need not be fulfilled, but fulfilling it is encouraged. If framed as a taʿliq ("if I marry another, your affairs are in your hands"), it is binding.
  • Shafi'i — a condition that restricts a right of the husband permitted by the Shariah (such as polygyny) is regarded as a defective condition (syarat fasid): it lapses, the contract is valid, and it may affect the mahr.

4A condition that the husband will not take another wife

This is one of the most frequent questions. In short:

  • Wife has the right to ask for this condition — it does not forbid what Allah has made lawful, because the husband is still free to choose; he simply bears the consequences if he breaches it (the Hanbali view).
  • According to the majority, this condition does not stop the husband marrying another wife and does not automatically give a right to fasakh — unless it is framed as a taʿliq.
  • For that reason, the safest way for a wife in Malaysia is to include it as a additional taʿliq or as a written agreement witnessed and registered together with the contract, not merely a verbal promise.
  • Some Muslim countries have codified this view: Jordan's Personal Status Law 2019, Article 37(a), upholds a wife's condition that her husband not marry another wife, and if it is breached the wife may apply for annulment (fasakh); Morocco's Family Code 2004, Article 40, prohibits polygyny if the wife stipulated it in the contract.
This condition is not a sign of mistrust. It is a way permitted by the Shariah for both parties to be open about their expectations before the contract. Discuss it honestly during the engagement stage.

5Taʿliq divorce in Malaysia

In every state in Malaysia, after the marriage contract the husband reads and signs the taʿliq pronouncement printed in the marriage certificate. Its legal position:

  • Act 303 s.22 and the equivalent state enactments require the marriage record to include the taʿliq.
  • Act 303 s.50 (divorce under taʿliq) allows a wife to apply to the Syariah Court to confirm the divorce if the taʿliq condition has occurred.
  • The standard taʿliq pronouncement is issued by the state religious authorities; the content is almost the same but the periods and details differ between states.
  • Couples may add an additional taʿliq (for example on polygyny or work) with the registrar's agreement and certification — check current practice with the state Islamic Religious Department.

6Sample taʿliq pronouncements

Below are short examples based on the form commonly used in Malaysia. The official text is the one printed in your state's marriage certificate.

"Whenever I leave my wife for four consecutive Hijri months or more, wilfully or by compulsion, and neither I nor my representative provide maintenance to her during that period although she is obedient to me, or I cause any harm to her body, and she then complains to the Syariah Court, and when her complaint is proven before the Syariah Court and she gives the Syariah Court, receiving on my behalf, one ringgit, then at that time she shall be divorced by way of talaq khulʿ."

Example of an additional taʿliq (if agreed and accepted by the registrar):

"Whenever I marry another woman without the knowledge and written consent of my wife, and she then complains to the Syariah Court and her complaint is proven, she shall be divorced by one talaq."
An additional taʿliq must be drafted clearly and certified by the registrar. Vague wording is hard to prove. Get advice from a Marriage Officer or a Syarie lawyer before the contract.

8Practical advice

For the prospective wifeRead the taʿliq pronouncement before the day of the contract. If polygyny is a major concern, discuss it openly and decide whether an additional taʿliq is needed.
For the prospective husbandDo not promise what you are not prepared to fulfil. A promise in the marriage contract is a trust (Surah al-Ma'idah 5:1: fulfil your contracts).
For the waliA wali may propose conditions that protect his daughter's welfare, but may not stipulate void matters such as syighar (exchange marriage).
For polygynous couplesIf the first wife has an additional taʿliq, a second marriage may trigger a talaq. Check the marriage certificate before applying for permission for polygyny.
