I worked in my husband’s shop for years without pay. Can the business be claimed as harta sepencarian?
It can be claimed, because unpaid work is a recognised contribution. Act 303 s.122(2)(a) refers to each party's contribution in money, property or labour towards acquiring an asset. If the business, its premises or assets bought from its profits were acquired during the marriage, your work in the shop can support a claim to a share. Its strength depends on evidence: company documents, initial capital, sales records, work schedules, photographs, and witnesses such as staff or regular customers. A business registered in the husband's name is not excluded just because of the name. The actual value and the way it is divided are decided by the court; get advice from a Syariah lawyer.
