If an asset was bought with the husband’s salary alone, does the wife still get a share?
She can, but the law gives the larger share to the party who acquired it. Act 303 s.122(3) lets the court divide assets acquired by the sole efforts of one party. Under s.122(4), the court weighs the contribution of the party who did not acquire the asset to the welfare of the family, by looking after the home or caring for the family, as well as the needs of minor children. The court then divides in the proportion it thinks reasonable, but the party by whose efforts the asset was acquired must receive the greater share. This differs from assets acquired by joint efforts, which the court inclines to divide equally after weighing contributions. Keep evidence of your role at home. See Harta sepencarian.
