How does a husband take his wife back (rujuk) during the ʿiddah?
A husband may take her back during the ʿiddah of a revocable talaq (raj'i) with clear words such as "I take you back", without a new contract or mahr.
In the Shafi'i school, rujuk must be by words; intercourse alone does not count as rujuk. Two witnesses are recommended. Rujuk must be with the intention of reconciling, not to harm the wife.
In Malaysia, rujuk must be reported and registered at the religious affairs office or Syariah Court according to the state Enactment. If the wife does not agree, the Enactments give her room to object through the prescribed channel. Once the ʿiddah has ended, rujuk is no longer possible; a new marriage contract is needed. Difference between schools. Hanafi and Hanbali: rujuk is also valid by action (intercourse/touch). Maliki: valid by action if accompanied by intention. Shafi'i: it must be by words.
