What is nikah misyar and is it valid?
A misyar marriage is a marriage that fulfils its pillars and conditions, but the wife willingly gives up some of her rights such as maintenance for housing or her nightly turn.
Some contemporary scholars consider it valid because the pillars of marriage are complete, although it is not encouraged. Other scholars criticise it because it can undermine women's rights and family stability, and the wife is entitled to reclaim the rights she gave up. In Malaysia, every marriage must be registered and follow the procedure, including polygyny permission where relevant. This is not a shortcut to a secret marriage. See Nikah siri, misyar & urfi.
