Step by step
Marriage guide
Two paths. The first is for a first marriage; the second for when you already have a wife. The order of the steps is the most important part.

A · First marriage
Pre-marriage course Register for and attend a recognised course. You will receive a Marriage Course Certificate — it is needed at step 4 and cannot be skipped.Timing: Take it as early as possible. Course places often fill up; this is the most common cause of delay.
HIV screening test Both the prospective bride and groom. Can be done at a government health clinic.Timing: Before submitting the forms. Results usually take a few days.
Collect the forms at the religious office The district Islamic Religious Office. Forms differ by state — ask at the counter for the form's name or code.
Complete the forms and get the wali's signature The forms must be signed by the bride's wali. Attach copies of all parties' identity cards, the course certificate, the HIV report, and photographs.
Employer's letter of permission if applicable Members of the armed forces, the police, and certain public service positions require a letter of permission.
Submit the application Usually at the bride's district religious office. Pay the fee set by the State; ask for the amount at the counter.
Permission to marry issued Once approved, you receive permission and a date can be set.Timing: Varies by state; ask at your religious office.
Akad nikah With the wali, two male witnesses, and an authorised marriage officiant (jurunikah). The mahr is handed to the wife.
Registration & marriage certificate The marriage is registered and a marriage certificate is issued. Keep a copy.Timing: Immediately after the akad.
B · Subsequent marriage — polygyny
The key difference: on this path, court permission must be obtained first. Steps 1 to 7 below must be completed before the akad. Marrying first and applying afterwards is an offence under the state enactments.
Assess yourself honestly Use the affordability calculator. If the numbers are not enough today, they will not be enough after the akad.
Prepare financial documents Recent payslips, bank statements, EPF (KWSP) statement, list of debts and commitments, details of existing dependants.Timing: Start early — this is the slowest part.
Tell your existing wife Not a legal requirement, but in most states she will be summoned to court (the Perlis and Terengganu texts do not mention this). Hearing it from you first is far better than hearing it from a summons.
File the application in the Syariah Court Not at the religious office. The enactments say only “the Court”. The hearing of applications for permission in the Syariah High Court rests on Practice Direction No. 14/2006 of the Department of Syariah Judiciary Malaysia (JKSM), and the trial of the offence of polygamy without permission in the Syariah Subordinate Court on Practice Direction No. 5/2007. Practice Direction No. 14/2006 has been read (in force from 1 June 2006; polygamy cases under Act 303 s.23 and the same section of the state enactments go to the Syariah High Court); the text of Practice Direction No. 5/2007 has not yet been read by this site. Include the “just or necessary” reason with supporting documents.
The court sets a hearing date In most states, the existing wife is summoned to be heard, and the court will summon the intended wife and her wali (the Perlis and Terengganu texts differ).Time: Varies by state and caseload; ask at the court counter.
Hearing The court assesses all four conditions: just or necessary, financial means, ability to be just, and absence of harm recognised by Syariah law (darar syarie) to the existing wife.
Permission order If approved, you receive a court order. If refused, the decision may be appealed. Maintenance and other orders may be issued at the same time.
Only then the usual marriage process After the order is obtained: course (if not yet taken), HIV test, forms at the religious office, and permission to marry — the same as path A step 1–7.
Akad nikah Wali, two witnesses, officiant. Mahr to the new wife.
Registration Register and obtain the marriage certificate. Without this, the marriage is not officially recognised — the new wife's rights are hard to claim until it is registered or confirmed by the court.Timing: Immediately.
Opening nights according to the sunnah Seven nights if the new wife has never been married; three nights if she has. After that, equal turns. al-Bukhari 5213 · Muslim, Kitab ar-Radha'
One practical tip. Keep one file — physical or digital — containing every document, receipt and order. Most problems that reach court arise not because people are untruthful, but because they cannot prove it.
