Islamic Family Law (Terengganu) Enactment 2017
Islamic family law for Terengganu, as held by this site. Every section has its own address, so references on this site can open the exact section.
Non-official copy. The text below is the text layer of a FlipHTML5 flipbook, a third-party upload of a 68-page print of this enactment. It is the only place the text was found: the e-Syariah portal holds only the repealed 1985 enactment, and the JKSM library catalogue sits behind a CAPTCHA. Sections 22, 125 and 126 in particular please check against the Terengganu gazette (En. Tr. 1/2017) before being relied on.

What this text shows
- Section 22 is a single sentence. It requires the written permission of the “Hakim Syarie”. There are no listed conditions, no iqrar on income and commitments, no summons to or service on the existing wife, and no power to order maintenance or the division of assets in that section.
- Section 22 says “Hakim Syarie”, while the offence section s.126 says “Mahkamah”. Section 2 defines “Mahkamah” as the Syariah Subordinate Court or the Syariah High Court, as the case may be.
- The s.126 penalty is heavier than Act 303 s.123: a fine not exceeding RM2,000 or imprisonment not exceeding one year or both. Section 125 is a separate offence, “Perkahwinan tanpa kebenaran”: a fine not exceeding RM5,000 or imprisonment not exceeding three years or both.
- Section numbers run one lower than Act 303 for s.12 to s.24: consent s.12, permission before the akad s.18, polygamy s.22, registration s.24. Section 24 sets the time limit: a marriage solemnised in Terengganu must be registered within twenty-one days. Division of harta sepencarian on divorce is s.59.
- According to the gazette notice printed in this copy (Tr. G.N. 1176, Terengganu Government Gazette, 23 November 2017), this enactment is deemed to have come into force on 1 July 2017. Section 141(1) repeals the Enakmen Undang-Undang Pentadbiran Keluarga Islam 1985.
- Polygamy applications are heard in the Syariah High Court because of JKSM Practice Direction No. 14 of 2006 (in effect from 1 June 2006), not because of this enactment; the text of that practice direction was read on 14 October 2026.
Verified against a primary source
- Commencement notice: Tr. G.N. 1176, Terengganu Government Gazette, Vol. 70 No. 24, 23 November 2017 (dated 25 October 2017): this enactment “hendaklah telah disifatkan mula berkuatkuasa pada 1 Julai 2017”. The notice matches the one printed in the non-official copy, and its English text gives the title “Islamic Family Law (Terengganu) Enactment 2017”. It confirms the date and the title only, not the text of the sections. Source: the gazette scan in the Sinar Project archive; checked 14 Oct 2026.
To be checked for this State

- Whether the 2018 and 2019 amendments mentioned in a publisher’s listing touched ss.22, 125 or 126: the text held carries no amendment notes. The check of 14 Oct 2026 searched 89 issues of the Terengganu Government Gazette for 2018 and 2019 (Sinar Project archive) and found no commencement notice for any amendment of this enactment.
- No English text was found.
- How the Terengganu court assesses applications in practice (practice directions or rules) lies outside this enactment and was not researched.
