Can the court impose conditions when approving polygyny?
Yes, the court has discretion to make ancillary orders along with the approval. For example, a monthly maintenance order for the existing wife and children, or division of harta sepencarian if requested (Act 303 s.23(9)(b); Selangor Enactment 2003 s.23(10)(b)). These orders are binding and can be enforced if the husband defaults. Besides court orders, the spouses may agree on matters such as accommodation and the rotation arrangement, but the effect depends on the form of that agreement.
