What are the conditions for someone to be qualified to exercise hadhanah?

Act 303 s.82 lists five conditions. A person entitled to bring up a child may exercise the right of hadhanah if they are: a Muslim; of sound mind; of an age that qualifies them to give the child the care, love and attention the child needs; of good conduct from the standpoint of Islamic morality; and living in a place where the child will not face moral or physical harm. These conditions are assessed on the real situation, not on accusations. If the other side disputes your qualification, prepare evidence such as the state of the home, the child's routine, and school and health records. State enactments have similar conditions. See Hadhanah & lineage.
