📜 Akad nikah · #48
May the akad nikah be held at home, or must it be in a mosque?
Yes — the place is not a condition for a valid contract; a marriage is valid at home, in a hall or in a mosque as long as its pillars and conditions are complete.
The pillars of marriage are the groom, the bride, the wali, two witnesses and the offer and acceptance; none of them relates to the location. Holding the contract in a mosque is a good practice common in Malaysia, but the narration telling people to hold marriages in the mosque is graded weak by hadith scholars, so it is not an obligation. What is required is that the marriage is announced, not kept secret.
In Malaysia, wherever the contract is held, it must be conducted by an authorised marriage registrar or official after permission to marry has been obtained, and registered under the state Enactment. Check the location requirements and fees with your district religious affairs office. See Marriage Contract and Procedure.
